Subject: EXTENSION OF CLARKE STREET, NEWCASTLE VILLAGE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-74-91 be received;
2 . THAT the Town of Newcastle accept ownership of the lands comprising
Part 5 of Plan 1OR-3328 and Part 1 of the draft plan subject to the
applicant Satisfying all requirements of the Public Works
Department;
3 . THAT the Town advertise Council's intention to establish and layout
the road and dedicate Part 5, Plan 1OR-3328 and Part 1 of the draft
Plan as a public road in accordance with the requirements of the
Municipal Act;
4 . THAT the conveyance of Part 5, Plan 1OR-3328 be subject to Norman
John Graham having the right to the use of the well located on Part
5 at his own risk for the duration of the time that he remains the
owner of the adjacent property known as 50 Clarke Street and that
this right of use be contained in the Town's deed to the property;

5. THAT Mr. Norman John Graham be required to pay a cash contribution
of $3,000 to pay the cost of upgrading the road to Town standards,
and pay all survey, advertising and legal costs associated with the
transaction;
6 . THAT the Town solicitor take all necessary steps to complete the
transaction;
7 . THAT the Mayor and Clerk be authorized to execute all documents
required to complete the transaction; and
8 . THAT Mr. Sam Cureatz be advised of Council 's decision and be given
a copy of Report WD-74-91.

2.0 BACKGROUND
2 . 1 Mr. Sam L. Cureatz on behalf of Norman John Graham requested that
the Town of Newcastle accept ownership of the lands comprising of
Part 5 of Plan 10R-3328 and Part 1 of a draft plan (as illustrated
on Attachment No. l) , dedicate the two parcels as a public road and
maintain the same as a public road.

3.0 REVIEW AND COMMENT
3 . 1 Although the Town does not own Part 5 of Plan 1OR-3328 and Part 1
of the draft plan, the Town has been maintaining a road on their
lands for several years . The estimated cost to bring the road up
to Town standards is $3,000 .

3.2 At the present time there is a well located at the west end of Part
5 . Mr. Cureatz has requested that his client, Mr. Graham have the
right to use this well as long as he is the owner of the adjacent
property, at his own risk.
4.0 RECOMMENDATION
4 . 1 That the Town of Newcastle accept ownership of the lands comprising
Part 5, Plan 1OR-3328 and Part 1 of the draft plan and that the
necessary steps be taken to assume those lands dedicated as public
road allowance at no cost to the Town.
That the applicant be granted permission to continue to use the
well on Part 5, Plan 1OR-3328 at his own risk and that the deed to
the land include this provision.
