THAT Report WD-72-91 be received; 2 . THAT the Mayor and Clerk be authorized to execute an agreement with Ontario Hydro satisfactory to the Director of Public Works to permit Ontario Hydro to use the following unmaintained road allowances in Concession 1, former Clarke Township: a) between Lots 10 and 11 b) between Lots 18 and 19 c) between Lots 26 and 27 (south of Highway 401) ; 3 . THAT Ontario Hydro execute an Indemnity Agreement satisfactory to the Town's solicitor; 4 . THAT Council approve the appropriate by-law; and 5. THAT Mr. L.R. Fawcett, Project Engineer, Transmission Lines Programs Department, Ontario Hydro, be advised of Council's decision. 2 I J REPORT NO. : WD-72-91 PAGE 2 REPORT 1.0 ATTACHMENTS No. l Key Map No.2 Correspondence from Ontario Hydro dated August 23, 1991 No. 3 Correspondence stating approvals dated June 14, 1991 2.0 BACKGROUND 2 . 1 Ontario Hydro, in their correspondence of August 23, 1991, (Attachment No.2) requested to use the unmaintained road allowance between Lots 10 and 11, 18 and 19, 26 and 27, Concession 1, former Clarke Township, to gain access to the Hydro corridor where they are constructing a second steel transmission line from Lennox Generating Station to Bowmanville Switching Station. It is proposed that construction of the line and the duration of the agreement extend from 1991 to 1995 . 2 .2 Construction of the existing line and the new line were approved by the Provincial Government in the mid 1970 's (Attachment No. 3) . 2 . 3 To access the unmaintained roads, it will be necessary for Ontario Hydro to perform some minor upgrading such as brushing of limbs and applying granular material. 2 .4 The agreement with Ontario Hydro is being prepared by the Town's solicitor and will include provision for restoration, insurance and indemnification to the satisfaction of the Director of Public Works . i i . . . 3 j I REPORT NO. : WD-72-91 PAGE 3 3.0 RECOMMENDATIONS: 3 . 1 That the appropriate by-law be passed authorizing the Mayor and Clerk to execute all the necessary documents to enter into an agreement with Ontario Hydro satisfactory to the Director of Public Works to permit the use of the specified unmaintained road allowances . Phone: (416) 623-3379 L1C 3A6 O Attn: Jan O'Neil Dear Madam: Ontario Hydro has commenced construction of a second 500 K.V. steel trans- mission line from Lennox G.S. to Bowmanville S.S. This line will be constructed within the existing corridor, and 175' north of the existing tower line. This corridor passes through part of Clarke Township and consequently the constructing of this line will impact the Township to some degree. Ontario Hydro will be travelling a number of the Township roads, as well as a few unmaintained road allowances. These unmaintained road allowances are as follows: a) between Lot 10 and 11, Conc 1 b) between Lot 18 and 19, Conc 1 c) between Lot 26 and 27, Conc 1 (JIt.[-�i,- ) . Ontario Hydro is also aware of a low Railroad Underpass (3.6m - 1118") on Conc 1, Lot 24. On behalf of Ontario Hydro I am requesting Council's approval to use these unmaintained roads to gain access to the Hydro corridor. Some minor upgrading may be required on these road allowances, such as brushing of limbs to a width of approximately 18 feet and a height of approximately 15 feet, as well as applying some granular material, where necessary. This material would consist of a 4" minus crushed limestone or equivalent pit run material. All costs to carry out the above mentioned work would be borne by Ontario Hydro. In the near future I will arrange to meet with the Road Superintendent, at which time, together we would map out the haul roads which Ontario Hydro and its' disciplines will travel during the construction of the tower line. continued. . . ' Construotion of a second high-voltage transmission line between the bowmanvilla switching Station and the LennQX Genorating station close to Napanee will begin next week near the Lennox Station. The new 500. kilOvelt line will parallel the existing ono, on the same right-of-way. Both lines were approved by the provincial government in the mid-i970s after public hearings (the Solandt OQMmi.ssion) , and no additional property rights are required. The second line is required to maintain an adequate and reliabl* electrical supply to customers in Xactorn Ontario. Crews will be on the right-of-way building access roads and* installing tower foundations this sWmer. Contracts tok clearing work will be advartised in local newspapers. The Corporation of the Town of Newcastle hereby enacts as follows: 1. That the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle, and seal with the Corporation Seal, an Agreement between Ontario Hydro and the said Corporation, in the form attached hereto as "Schedule A". 2. That Schedule 'A' attached hereto forms part of this by-law. By-law read a first time this 15th day of October 1991. By-law read a second time this 15th day of October 1991.
