K., Date: September 9, 1991 Res. # Report#: WD-70-91 File #: D. 05 . 18 . 17 By-Law# Subject: CLOSURE OF A PORTION OF KERR AVENUE TO VEHICULAR TRAFFIC IN THE HAMLET OF HAMPTON LOT 18, CONCESSION 5, FORMER DARLINGTON PART 2, PLAN 1OR-4050 ]BETWEEN OLD SCUGOG ROAD AND PERRY AVENUE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-70-91 be received; 2 . THAT the easterly portion of the road allowance known as Kerr Avenue in Hampton (Part 2, Plan 1OR-4050) , be closed to vehicular traffic (Attachment No. 1) ; 3 . THAT a pedestrian walkway be constructed on the closed portion of the laneway from Perry Street to 52 metres ( 158 feet) east of Old Scugog Road (Attachment No.2) with permanent barricades placed to prevent all vehicular traffic; 4 . THAT the proposed by-law be advertised for four consecutive weeks in accordance with the requirements of the Municipal Act; 5 . THAT the Town's solicitor be directed to take all actions necessary to complete the transaction; and 2 REPORT NO. : WD-70-91 PAGE 2 6 . THAT all abutting property owners be advised of Council's decision. ------------------------------------------------ REPORT 1.0 ATTACHMENTS No. l: Key Map No.2 : Proposed Pedestrian Walkway 2.0 BACKGROUND 2 . 1 Kerr Avenue Kerr Avenue is an existing laneway between Old Scugog Road and Perry Avenue in Hampton. Kerr Avenue was created as a laneway between Village Lots 23 and 24 and Village Lots 26 and 27, according to Perry's Plan of the Unincorporated Village of Hampton. In 1986, the Public Works Department installed a storm sewer system on Perry Avenue with the outfall to Bowmanville Creek via Kerr Avenue. Kerr Avenue was physically closed to perform the storm sewer construction and it was not reopened to vehicular traffic. It is therefore appropriate to legally close the road but the lands will not be conveyed as it would necessitate an easement. 2 .2 The Problem 1) Kerr Avenue is 5 metres ( 16 .5 feet) wide; I 2) Over the years, as a result of vehicular traffic and routine maintenance, the width of the "travelled road" increased and encroached onto private property, mostly to the south (Balson) . . . .3 i REPORT NO. : WD-70-91 PAGE 3 2 . 3 Kerr Avenue is currently used by the two homeowners at the west end of the laneway to gain access to their properties and by pedestrians especially school children. It was determined through discussions with residents that a pedestrian walkway would be acceptable if the easterly end of the laneway was closed by by- law. 2 .4 Adjacent Property Owners Mr. & Mrs . Gerald Balson own the property on the south side of Kerr Avenue. Mr. Duff and Mrs . Charette own the property on the north side of Kerr Avenue. Letters were sent to all residents abutting Kerr Avenue as well as the laneway which runs perpendicular and to the north of Kerr Avenue. A public meeting was held on Thursday, June 28, 1990 . Two residents adjacent to Kerr Avenue attended the meeting, Mr. Balson and Mrs . Charette. Both property owners were in favour of closing Kerr Avenue to vehicular traffic and the construction of a pedestrian walkway. Mr. Duff, property owner to the north, was contacted and he is also in favour of the closure and walkway construction. Mr. Balson and Mr. Duff will continue to use the westerly portion of the laneway as access to their property. This portion will not be closed. 3.0 CIRCULATION 3 . 1 The proposal to close Kerr Avenue was circulated to all departments, agencies and authorities . No objections were received. . . .4 I REPORT NO. : WD-70-91 PAGE 4 4.0 COST OF CLOSURE 4 . 1 Survey Costs $ 1200. 00 Cost Estimate of Pedestrian Walkway ( 1990) 22,420 . 00 Legal Costs 100 . 00 TOTAL $23,720 . 00 Funds for construction of the walkway were approved in the 1991 Budget. 5.0 CONSTRUCTION AND MAINTENANCE OF PROPOSED WALKWAY 5 . 1 The Town is proposing to construct a pedestrian walkway from 52 metres ( 158 feet) east of Old Scugog Road to Perry Avenue. The Town will be responsible to maintain the walkway on a year round basis . All abutting land owners agree with the closure of Kerr Avenue and the construction of the proposed walkway. 6 . 2 Vehicles still attempt to use Kerr Avenue even though temporary barricades have been placed. It is my opinion that permanent, effective barricades are necessary to protect pedestrians and the property of the abutting owners . 7.0 RECOMMENDATION 7 . 1 It is, therefore recommended that Kerr Avenue from approximately 52 m ( 158 feet) east of Old Scugog Road to Perry Avenue (Part 2, Plan 1OR-4050) be closed to vehicular traffic by by-law and that a pedestrian walkway be constructed.
