G. HANNING,S PLAN OF THE VILLAGE OF ORONO BEING PART OF LOT 28, CONCESSION 5, FORMER TOWNSHIP OF CLARKE Recommendations: It is respectfully recommended that the Council approve the following: 1. THAT Report WD-69-91 be received; 2 . THAT a building permit be issued to Mr. & Mrs. Cox subject to the applicant satisfying the requirements of the Building Division and upon receipt of a registered reference plan illustrating the encroachments onto Dickson Street and Mill Street; 3 . THAT upon receipt of the reference plan Council pass a by-law authorizing the encroachment onto Dickson Street and Mill Street at a nominal cost of $2 . 00; 4 . THAT the applicant be responsible for all costs such as survey and legal costs associated with this permit; 5 . THAT the Town Solicitor be directed to take all actions necessary to complete the transaction; and 6 . THAT Mr. & Mrs . Tom Cox be advised of Council's decision. ------------------------------------------------------------------- 2 REPORT NO. : WD-69-91 PAGE 2 REPORT 1.0 ATTACHMENT No. l: Key Map 2.0 BACKGROUND 2 . 1 Tom and Karen Cox applied for a building permit to add a second story to their existing house. 2 .2 The existing house encroaches onto public road allowance in two locations; on Dickson Street the house encroaches by 0 . 027 m ( 0. 09 feet) and the porch encroaches onto Mill Street by 1. 189 m (3.9 feet) (Attachment No. l) . 2 . 3 To receive their building permit and comply with the Building Code the encroachments onto public road allowance must be authorized by Council by by-law. The by-law cannot be passed without a registered reference plan. The plan is currently being prepared by Brown & Coggan. 2 .4 This report has been discussed with the Building Division and they concur with the recommendations of this report. i 3.0 RECOMMENDATION 3 . 1 It is, therefore, recommended that Council approve the issuance of the building permit subject to receipt of the required reference plan and that the by-law be passed when the reference plan is available.
