SECT: EXPROPRIATION OF .ONE FOOT RESERVE AT EAST END OF
TYLER AND BRADLEY STREETS, MITCHELL CORNERS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-50-91 be received;
2 . THAT appropriate Town officials take the necessary action to
initiate and prosecute expropriation of the reserves located at the
east end of Tyler Street and Bradley Street; and
3 . THAT Mr. Ralph Jones, Jones & Jones, be advised of Council's
decision.

2.0 BACKGROUND
2 . 1 In 1990, the Town constructed a laneway and access onto the
McMaster property from Courtice Road. The access was constructed
to improve safety on Taunton Road and to close access to the east
end of Tyler and Bradley Streets by farm vehicles and large trucks
entering the McMaster farm.

In exchange, Mr. McMaster conveyed land to construct turn-a-rounds
at the easterly limits of Tyler and Bradley Streets. The turn-a-
arounds have been constructed and fenced.
2 .2 The Problem:
A one foot reserve exists at the east limits of Tyler and Bradley
Streets . The one foot reserves were created by Registered Plan 639
in 1954 but were never dedicated to the Town by Hillcrest Estates
Limited.
Jones & Jones were the solicitors acting for the developer at the
time the plan was registered. Numerous attempts by myself and our
solicitor to have the one foot reserves dedicated have been
unsuccessful. Therefore, it is the recommended that the one foot

reserves be expropriated and dedicated as public road allowances.
