SUBJECT: PROPOSED INSTALLATION OF ROAD CROSSING WARNING SIGNALS AT
CANADIAN NATIONAL RAILWAY LEVEL CROSSING, TORONTO STREET,
C.N. MILE 286.75, KINGSTON SUBDIVISION, NEWCASTLE VILLAGE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-29-91 be received;
2 . THAT subject to approval of the 1991 Budget, the Canadian National
Railway be advised that the Corporation of the Town of Newcastle
agrees:
a) To pay 12-1/2% of the costs of the installation of Road
Crossing Warning Signals at the level crossing of Canadian
National Rail and Toronto Street in the Village of Newcastle,
C.N. Mile 286 . 75, Kingston Subdivision; and
b) To pay 50% of the cost of the maintenance of the Road Crossing
Warning Signals; and
3 . THAT a copy of Report WD-29-91 be forwarded to the Honourable Doug
Lewis, Minister of Transport, P.L. Ross, District Manager, C.N.
and S.A. Cantin, General Solicitor, C.N. and that they be advised
of Council 's decision.

2.0 BACKGROUND
2 . 1 At the request of Transport Canada, a site meeting was arranged
with Canadian National Railway, Transport Canada and Town of
Newcastle on April 18, 1990, to inspect the crossing of the
Canadian National Railway and Toronto Street in the Village of
Newcastle. The Railway Safety Inspector from Transport Canada
recommended that an Automatic Warning System be installed
2 .2 On June 31, 1990, a fatality occurred at this crossing.
3.0 REVIEW AND COMMENT
3. 1 The average annual daily traffic on Toronto Street is 24 vehicles
per day and the average train traffic is 39 trains per day. This
traffic gives an exposure index of 936 which is just under the
index of 1000 at which point the installation of an automated
warning system is warranted. In addition, there are several
applications for development in this area (Attachment No. 4) .

3 .2 The present crossing surface does not meet Transport Canada's
standards . To improve the safety of this crossing, the road
approaches must be widened to a 8 m (26 feet) surface including
shoulders for a distance of 15 m (50 feet) from the crossing. The
grade to the north must be improved slightly to meet the maximum
5% grade requirements . The Railway is responsible to widen the
crossing surface between the tracks and the Town is responsible for
the construction of the roadway approaches. The estimated cost for
road widening and grade improvement is $7,000.
3 .3 The Automated Warning System will include flashing lights with bell
and short arm gates which are the minimum requirements for a
crossing with double tracks. Canadian National Railway must have
an agreement with the Town of Newcastle for funding in place before
federal funding can be provided by the Minister of Transport.
Canadian National are requesting that the Town pay 12-1/2% of the
installation costs which is consistent with other cost sharing
arrangements . The Minister of Transport will pay 80% of the cost,
Canadian National will pay 7-1/2% of the cost and the Town of
Newcastle is required to pay 12-1/2% of the cost
3 .4 The total estimated cost for the project is $187,000 . The cost of
the project will be shared as follows:

In addition to the construction costs, the Town's portion of the
yearly maintenance cost will be approximately $2,800 .
4.0 CONCLUSIONS
4 . 1 Road Crossing Warning Signals are warranted at the Toronto
Street/C.N. Rail Crossing.
4 .2 The Town of Newcastle should support and agree to pay their share
of the cost of the installation and maintenance of Road Crossing
Warning Signals at the crossing.

RE: Installation of Road Crossing Warning Signals (RCWSs), etc. at Boundary Road,
between Lots 30 & 31 Concession I, Town of Newcastle, Ontario - CN mile 286.75
Kingston Subdivision.
This is further to our site meeting of April 18, 1990 and Transport Canada's letter
of May 14, 1990 requesting inputs relating to the possible installation of RCWSs at this
crossing. The Railway at the meeting stated it would have its existing estimate for the
installation of RCWSs at this crossing updated and that the Railway had no objection to
this installation and was prepared to contribute in accordance with the present cost
sharing formula.
The Railway, has had this estimate for RCWSs updated on the expectation that
the traffic counts, etc. at this crossing will qualify it for a federal grant. On this basis the
Railway submits this estimate to the Town for their concurrence or otherwise before
proceeding with an application to the Minister of Transport for funding assistance.
The present procedure is for the Railway to apply to the Minister for a funding
contribute of up to 80% of the eligible costs for the installation on the basis that the
Town would contribute 12 1/2% and the Railway would contribute the remainder. The
cost sharing for the future maintenance of the RCWSs would be shared 50-50between
the Town and Railway. This maintenance cost would be similar to other CN RCWSs
installations in Newcastle.
I have now been advised verbally that the revised cost estimate for the
installation of RCWSs at this crossing is $180,000 made up of $167,670 for signal work
and $12,330 for track work related to the RCWSs. I shall forward a copy of the detailed
estimate as soon as received.
The Railway is prepared to file an application to the Minister of Transport for
funding assistance as noted above upon receipt of the Town's concurrence to cost
sharing. The Railway, following the approval of funding assistance from tl,e Minister of
Transport would proceed to install the RCWSs at this crossing.

In respect to the matter of widening the road approaches and improving the road
profile as was also discussed at the site. The Railway is junior at this crossing and
therefore is prepared to widen the crossing surfaces to match the widened roadway as
well as being responsible for the future maintenance of these crossing surfaces at its
expense. The Town would be expected at its costs to improve the road approaches as
per Transport Canada's letter.
I trust this provides adequate information that will permit the Town to reach a
decision relating to proposed improvements at this crossing. The Railway as indicated
above it prepared to file an application with the Minister of Transport for funding
assistance for the installation of RCWSs, should the Town so concur. Should the Town

This is further to my letter of June 6, 1990 forwarding the overall price for the
installation of RCWSs at the above crossing, Attached as advised is a copy of the
detailed estimate # 00044A, dated June 4, 1990 for the Signal work related to this
installation totalling $ 167,670, Track work related to this installation as advised would

Contingencies $ 1.M

The attached list reflects current approved applications for the
southerly portion of Newcastle Village Urban Area - south of the
401. Within the Town Official Plan, population allocated for the
southerly portions of the Village equal 1500 persons. It is
Staff's understanding that an application is in the process of
being submitted for this area of the Village in excess of this
population number. I unfortunately can not confirm the size
being contemplated.

Avocats installation of warning devices with gates at the
subject crossing as shown on Sketch No .
SK-G0044A, copy of which is enclosed. As this
railway work will improve the safety of this
crossing , Canadian National , ' as the party
proposing to undertake the work, hereby makes
application under Section 12 (1) (a) of the Railway
Safety Act, R. S.C. 1985, c.32 (4th Supplement)
for a grant of 80% in respect of the cost of this
proposed railway work.
The estimated cost to install this road crossing
warning system at the above location is
$ 167 , 670 . 00 , as evidenced by the attached

The track work related to this installation is

Canadian National has no objection to the proposed
railway work and, provided:
1) the Minister authorizes a grant of 80% towards
the work;
2) the Town of Newcastle agrees to contribute
12 1/2% towards the cost of the work and also
agrees to accept 50% of the cost of future
maintenance of this road crossing warning
system;
the Railway shall carry out the recommended
installation.
