THAT Report WD-19-91 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plan 1OM-775; and 3 . THAT Council approve the by-law attached to Report WD-19-91 assuming the streets within Plan 1OM-775, as public highways . --------------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. l: Key Map No.2 : Road Assumption By-law for Plan 1OM-775 REPORT NO. : WD-19-91 PAGE 2 2.0 BACKGROUND 2 . 1 On May 6, 1986, the Town entered into a subdivision agreement with Huron Trail Development Group Limited to develop lands by plan of subdivision, located in Enniskillen and described as Plan 1OM-775 (Attachment No. l) . The agreement required the developer to construct all roadworks including hot-mix paving, granular shoulders, sodded ditches, street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works ' . 2 .2 All of the Works were completed and a 'Certificate of Completion' was issued dated October 30, 1989 . The Works were placed on a one year maintenance period which expired on October 30, 1990 . These Works were subsequently re-inspected and were found to be satisfactory. 2 . 3 It is now appropriate to issue a 'Certificate of Acceptance' for the Works . The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by- law is required to permit the Town to assume all the streets within Plan 1OM-775 . DATE - JAN. 1991 IF ATTACHMENT NO. 1 KEY MAP `JD_19`91 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91- Being a By-Law to assume certain streets within the Town of Newcastle as public highways in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1. THAT the streets, street widening blocks and site triangle blocks described in Registered Plan 1OM-775 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-775.
