Res. # By-Law # MEETING: General Purpose and Administration Committee DATE: February 4 1991 REPORT #: WD-12-91 FILE #: SUB.ECT: Water Service Connections in part of the Courtice Urban Area RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That Report WD-12-91 be received for information and any appropriate action. 1 . 0 ATTACHMENTS Attachment #1 - Resolution GPA-58-88 Attachment #2 - Resolution of the Regional Council passed on November 18 1989 respecting "Construction of Watermains in the Courtice Urban Area (Newcastle) " Attachment #3 - Policy of the Town of Newcastle with respect . to dewatering and/or interference to private wells caused by the Town of Newcastle at no cost to the affected party 2 . 0 BACKGROUND: 2 . 1 Resolution #GPA-58-88 (Attachment #1) approved by Council on WD-12-91 Page 2 January 18 1988, directed appropriate staff and the Chief Administrative Officer to review the policy for servicing existing homes in the Courtice Area and report back to Committee. 2 .2 The servicing of the Courtice Urban Area in the Town of Newcastle with trunk sanitary sewers and water feedermains commenced in 1979 . Financing for the work was provided for through Ontario Housing Action Program (OHAP) loans under an agreement between the Region of Durham and the Ministry of Housing. 2 .3 More recently some residents in the developing area experienced problems with their wells . Water in some of the wells was contaminated and in a number of cases, the wells had dried up or were producing an insufficient amount of water. 2 .4 Many of these residents felt that the problems resulted from the construction of services for the adjacent subdivisions. 1987 was an extremely dry year, with only about half the normal rain falling to the end of May, 1987 . This also contributed to the water problem. 2 .5 The Region's Commissioner of Works reported to the Region's Works Committee on November 10 1987 (Report 220-87) recommending the construction of watermains in the Courtice Urban Area. The Commissioner noted that the Town of Newcastle had requested funding assistance from the Ministry of the Environment to construct watermains and service connections to service existing homes in the area where problems were being experienced. 2 .6 The Ministry of the Environment in fact provided a grant of approximately 60% to be applied to the cost of watermains and service connections for this purpose. The balance of the funding required was raised by the Region. !J 'J WD-12-91 Page 3 2 . 7 With regard to frontage charges and service connections to existing homes, the Regional Council's policy approved on November 18 1987 was to exempt from frontage charge payments residents experiencing problems within the area affected by development whose properties abutted existing watermains . The connection charge for existing houses on a number of streets including parts of Varcoe Road and Prestonvale Road was limited to $300 each for existing homes . Once connected to the water system, water usage charges were to be based on water meter readings and the Regional Water Rates as approved by the Regional Council. 2 . 8 The full text of the Regional Council 's policy approved on November 18 1987 is set out in Attachment #2 to this report. 2 . 9 The new frontage and connection charge policy for existing homes in the affected area applied in respect of existing homes whose owners requested water service after November 18 1987 . 2 . 10 Two existing homes within the area to which the Region's water policy applied had been connected to the water service earlier in 1987 . Jan Hawryszko (Part Lot 33, Concession 2) , Prestonvale Road had paid frontage and service connection charges of $4342 . 98 on October 26 1987 . Joseph and Pamela Good, 68 Varcoe Road had paid $5376 .92 on May 7 1987 . 2 . 11 Several other properties in the area to which the Region's new water policy of November 18 1987 applied had been serviced with Regional water prior to November 18 1987 at times when there were existing homes located on them. Two properties were serviced in 1986; three properties were serviced in 1985; and seven properties were serviced prior to 1985 . 2 . 12 Mr. Hawryszko severed a lot from his Prestonvale Road property i I WD-12-91 Page 4 in 1989 (LP/436/89) . The land associated with his home which had existed in 1987 was reduced in frontage. If he had owned only the reduced frontage in 1987 the frontage and connection charges that he would have been required to pay to the Region would have totalled $3245. 10 rather than $4342 . 98 . 2 . 13 The timing of the establishment of the Region's new water policy (November 18 1987) from the standpoint of Jan Hawryszko and Joseph and Pamela Good was very unfortunate. The policy did not provide for any rebate of payments that had been made to the Region by owners of existing homes within the affected area who had paid water frontage and connection charges prior to November 18 1987 . 2 . 14 The Town's policy has been examined with respect to dewatering and/or interference to private wells caused by the Town at no cost to the affected party. (Refer to Attachment #3) . Although the Town's policy is not of assistance to Jan Hawryszko or Joseph and Pamela Good, the policy is considered to be sound and it is not suggested that it be changed at this time. 2 . 15 The Town's Solicitor, Mr. Dennis Hefferon advises that if Council decides to compensate Jan Hawryszko or Joseph and Pamela Good for the amount of the water frontage and connection charges that they paid, less the $300 connection fee required by the Region's policy of November 18 1987, this may be accomplished through authority under the Municipal Act to make compensating payments as grants to individuals . WD-12-91 AJWA �t 1 • CONSTRUCTION OF WATERMAINS IN THE COURTICE URBAN AREA (NEWCASTLE) RECOMMENDATIONS TO COUNCIL (AS AMENDED) a) THAT the Commissioner of Works be authorized to expend funds to insulate temporary watermains and connections where necessary to provide protection from possible freezing; the cost of any insulation to be charged to the watermain project involved; b) THAT the construction of watermains and connections to the property line be undertaken on the following streets in 1987 at an estimated total cost of $822,000: Darlington Blvd. - Highway 2 to 500 m south Phair Ave. - Prestonvale Rd, to Sandringham Dr. Prestonvale Rd. - Phair Ave. to 245 m south Prestonvale Rd. - 542 m south of Hwy 2 to 787 m south of Hwy 2 Townline Rd. - 175 m south of Hwy 2 to 280 m south of Hwy 2 Varcoe Rd. - Hwy 2 to Nash Rd. c) THAT the following watermains and connections to the property line, at an estimated cost of $1 ,302,000 be constructed in 1988: Nash Rd. - Townline Rd, to Varcoe Rd. Nash Rd. - Tooley' s Rd. to 75 m east Nash Rd. - Trulls Rd. to 490 m west Highway 2 (north side) - Prestonvale Rd. to Trulls Rd. Highway 2 (south side) - Prestonvale Rd. to Trulls Rd. d) i) THAT the imposition of frontage charges for water service be set aside for new watermain construction to serve existing buildings in the areas of Courtice where watermains are proposed for construction in Report #220-87 of the Commissioner of Works; ii ) THAT the residents experiencing problems within the area affected by development, who abut existing watermains, be given exemption from frontage charge payments ( for existing hoines) ; the exception to this policy would be those properties where frontage charges have been previously assessed; w e) THAT the connection rate to be imposed on the owners of properties located on the following streets be $300 for existing homes: Townline Rd. - Hwy 2 to 280 m south of Hwy 2 Darlington Blvd. - Hwy 2 to south limit of street Varcoe Rd. - Hwy 2 to approx. 610 m north of Nash Rd. Old Kingston Rd. - Hwy 2 to Prestonvale Rd. Prestonvale Rd. - Hwy 2 to 787 m south of Hwy 2 Phair Avenue - Sandringham Dr. to Prestonvale Rd. ,Hwy 2 - Prestonvale Rd. to Trulls Rd. . dash Rd. - Townline Rd. to Varcoe Rd. Nash Rd. - Tooley' s Rd. to 75 m east Nash Rd. - Trulls Rd. to 490 m west 7rulls Rd. - Devondale Rd. to 507 m south of Hwy 2 f) THAT, once connected to the water system, the residents abutting the watermains mentioned in Recommendations b) and ?'A)-.be charged for water usage based on water meter readings . and the Regional Water Rates as approved by Council ; 9) ''THAT in the event that properties serviced as a result of ;'these projects are severed or subdivided in the future, the Region retains the right to collect frontage and connection -,"'Cha'rges for any new lots created; all respective charges all be calculated in accordance with Regional policies ;existing at the time of creation of the new lots; h) };WHAT the financing of watermain extensions to service the remaining unserviced areas of Courtice be examined as part of ..remaining annual Water and Sanitary Sewer Servicing and Financing Study; i ) THAT as a condition of providing water service to the residents abutting Highway 2 between Prestonvale Rd. and :Trulls Rd. , the property owners be required to grant easements free of charge to the Region across the width of .:their lots; j) THAT the developers contributing the $600,000 payment toward the cost of the watermains proposed for construction in 1987 and 1988 be reimbursed up to a maximum of 50% of their Contribution in subsequent years providing the Region 'implements a lot levy increase in the Courtice Urban Area for Correction of well interference problems in the Courtice ,Urban Area. k) THAT for watermains constructed under Clause 9, Additional Works of the Subdivision Agreements, the respective developers be required to obtain three bids from prospective contractors. 1 ) THAT this be conditional upon the Region receiving the Payment of $600,000. ATTACHMENT 43 TO REPORT WD-12-91 POLICY OF THE TOWN OF NEWCASTLE WITH RESPECT TO DE- POLICY/PROCEDURE : WATERING AND/OR INTERFERENCE TO PRIVATE WELLS CAUSED BY THE TOWN OF NEWCASTLE AT NO COST TO THE AFFECTED PARTY DATE PASSED: RESOLUTION/BY-LAW NUMBER: 1. Where the interference to a well or private water supply is of short-term duration, during the course of excavation and within one month of the completion of dewatErir.g, the Town will makE- a�aileble to the affected party a temporary supply of water, at no cost to the affected party. 2. Where the interference to a well or private water supply is of long-term or permanent duration, outside a water-serviced area, the Town will take whatever action is deemed necessary, by the Director of Public Works , to restore the water supply. 3. Should a property affected by Clauses 1 & 2 be eventually serviced by a watermain then the affected property owner shall be responsible for whatever action is required in accordance with Regional Policy at that time. 4. Where the interference to a well or private water supply is of long-term or permanent duration, and where the interference takes place in a water-serviced area , the affected party will be required to make a payment of $200.00 (Two Hundred Dollars) effective February, 1978, towards the cost of the connection from the main to the street line , and will be responsible for the full cost of any work necessary on private property. THE TOWN OF NEWCASTLE WILL NOT BE RESPONSIBLE FOR ANY ASSESSED REGIONAL FRONTAGE CHARGES. i
