ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS AND
OTHER RELATED WORKS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-7-91 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage system,
street lights and other related Works, constructed within Plan
10M-772; and
3 . THAT Council approve the by-law attached to Report WD-7-91 assuming
the streets within Plan 1OM-772, as public highways .

2.0 BACKGROUND
2 . 1 On May 8, 1984, the Town entered into a subdivision agreement with
Claret Investments Limited and Rexgate Holdings Limited to develop
lands by plan of subdivision, located in Courtice and described as
Plan 1OM-772 (see Attachment No. l) . The agreement required the
developer to construct all roadworks including hot-mix paving, curb
and gutter, sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as the
'Works ' .
2 .2 All of the Works were completed and a 'Certificate of Completion'
was issued dated November 1, 1987 . The Works were placed on a
two year maintenance period which expired on November 1, 1989 .
These Works were subsequently re-inspected and were found to be
satisfactory.
2 . 3 It is now appropriate to issue a 'Certificate of Acceptance' for
the Works . The subdivision agreement provides for this certificate
to be issued by the Director of Public Works, subject to the
approval of Council .
2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by-
law is required to permit the Town to assume all the streets within
Plan 1OM-772 .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 91-
Being a By-Law to assume certain streets within the Town
of Newcastle as public highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follow:
1. THAT the streets, street widening blocks and reserve blocks
described in Registered Plan 1OM-772 (described in Schedule "A"
attached hereto and forming part of this By-Law) all being in the
Town of Newcastle, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for public
use.
2. THAT the Clerk be authorized to apply to the Land Registry
Office to have the Corporation of the Town of Newcastle shown
as the owner of the streets on Plan 1OM-772.
BY-LAW read a first time this day of 1991.
BY-LAW read a second time this day of 1991.
BY-LAW read a third and finally passed this day of 1991.
