HomeMy WebLinkAboutWD-5-91 TOWN OF NEWCASTLE REPORT File # Res. # �'— ���~��• By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: JANUARY 7, 1991 REPORT #: WD-5-91 FILE #:D.01.30 - 006 SUBJECT: CIGAS ROAD EXTENSION, PLAN 1OR-3164, 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' , ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS AND OTHER RELATED WORKS �< RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-5-91 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plan 1OR-3164; and 3 . THAT Council approve the by-law attached to Report WD-5-91 assuming the streets within Plan 1OR-3164, as public highways. ------------------------------------------------ REPORT 1.0 ATTACHMENTS No. l: Key Map No.2 : Road Assumption By-law for Plan 1OR-3164 . . , 2 REPORT NO. : WD-5-91 PAGE 2 2.0 BACKGROUND 2 . 1 Through the Land Division process, Veltri and Sons was required to construct a portion of Cigas Road, located in Courtice and described as Plan 1OR-3164 (see attachment No. 1) . Veltri and Sons Limited was required to construct all roadworks including hot-mix paving, ditches, and street lights, and the removal and restoration of the existing cul-de-sacs, herein after referred to as the 'Works ' . 2 .2 All of the Works were completed and a 'Certificate of Completion' was issued dated November 28, 1989 . The Works were placed on a one year maintenance period which expired on November 28, 1990. These Works were subsequently re-inspected and were found to be satisfactory. 2 . 3 It is now appropriate to issue a 'Certificate of Acceptance' for the Works . 2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by- law is required to permit the Town to assume all the streets within Plan 1OR-3164 . DATE : OCT. 1990 O �� RD t r,Y ATTACHME T 110 . 1 l.) j9 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 91- Being a By-Law to assume certain streets within the Town of Newcastle as public highways in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1. THAT the streets and street widening blocks located in Part•Lot 30, Concession 1, (formerly Township of Darlington), now in the Town of Newcastle, more particularly described as Part 3 and Part 7 in Registered Plan 1OR-3164 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OR-3164 BY-LAW read a first time this day of 1991.
