HomeMy WebLinkAboutWD-11-92 THE CORPORATION OF THE TOWN OF NEWCASTLE REPORT Meeting: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE File# Date: FEBRUARY 3, 1992 Res. # Report#:_WD-11-92 - File#: _-R._01. 08 -002 By-Law# _19- Subject: RIVERVALLEY ESTATES, PHASE 3, PLAN 1OM-798 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' , ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS AND OTHER RELATED WORKS Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-11-92 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plan 1OM-798; and 3. THAT Council approve the by-law attached to Report WD-11-92 assuming the streets within Plan 1OM-798 as public highways. ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2 : Road Assumption By-law for Plan 1OM-798 2.0 BACKGROUND 2 . 1 On July 30, 1986, the Town entered into a subdivision agreement with Veltri and Son Corporation to develop lands by /2 REPORT NO. : WD-11-92 PAGE 2 plan of subdivision, located in Bowmanville and described as Plan 1OM-798 (Attachment No. 1) . The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works ' . 2 .2 The subdivision agreement allows the Works to be separated into two (2) stages: I a) Initial Stage Works, (sewers and base roadworks) and, b) Final Stage Works, (boulevards, sidewalks and surface asphalt) 2 . 3 The Initial Stage Works were completed and a 'Certificate of Completion' was issued August 16, 1988 . The Works were subsequently placed on a two (2) year maintenance period. 2 .4 The Final Stage Works were completed and a 'Certificate of Completion' was issued July 16, 1990. These Works were placed on a one year maintenance period which expired July 16, 1991. 2 .5 Both stages of the Works were subsequently re-inspected at that time and were found to be satisfactory. 2 . 6 It is now appropriate to issue a 'Certificate of Acceptance' for all of the Works . The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. i . . /3 0 01 REPORT NO. : WD- -92 PAGE 3 2 . 7 Further to the issuance of a "Certificate of Acceptance' , a by-law is required to permit the Town to assume all the streets within Plan 1OM-798 (Attachment No. 2) . NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets and street widening described in Registered Plan 1OM-798 (described in Schedule "A" attached hereto and forming part of this By-law) , all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-798. BY-LAW read a first and second time this day of 1992. BY-LAW read a third time and finally passed this day of 1992.
