Subject: COURTICE HEIGHTS NORTH, PHASE 2, PLAN 1OM-783
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ,
ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS
AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-14-92 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage
system, street lights and other related Works, constructed
within Plan 1OM-783; and
3 . THAT Council approve the by-law attached to Report WD-14-92
assuming the streets within Plan 1OM-783 as public highways.

2.0 BACKGROUND
2 . 1 On May 8, 1984, the Town entered into a subdivision agreement
with Claret Investments Limited and Rexgate Holdings Limited
to develop lands by plan of subdivision, located in Courtice
and described as Plan 1OM-783 (Attachment No. 1) . The
agreement required the developer to construct all roadworks,

including hot-mix paving, curb and gutter, sidewalks,
boulevard sodding and street trees, a storm drainage system
and street lights, hereinafter referred to as the 'Works ' .
2 .2 This particular subdivision agreement does not permit the
separation of the Works into Initial and Final Stages.
Instead, it provides for the issuance of a single 'Certificate
of Completion' , to be issued upon the completion of all of the
Works .
2 . 3 All of the Works were completed and a 'Certificate of
Completion' was issued dated September 1, 1989 . The Works
were placed on a two (2) year maintenance period which expired
September 1, 1991.
2 .4 All of the Works were subsequently re-inspected and were found
to be satisfactory.
2 .5 It is now appropriate t ,
o issue a Certificate of Acceptance
for all of the Works . The subdivision agreement provides for
this certificate to be issued by the Director of Public Works,
subject to the approval of Council.
2 . 6 Further to the issuance of a "Certificate of Acceptance' , a
by-law is required to permit the Town to assume all the
streets within Plan 1OM-783 (Attachment No. 2) .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 92-
Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. THAT the streets and reserve blocks described in Registered
Plan 1OM-783 (described in Schedule "A" attached hereto and
forming part of this By-law) , all being in the Town of
Newcastle, in the Regional Municipality of Durham, are hereby
accepted by the Corporation of the Town of Newcastle as public
highways, and assumed by the said Corporation for public use.
2. THAT the Clerk be authorized to apply to the Land Registry
Office to have the Corporation of the Town-of Newcastle shown
as the owner of the streets on Plan 1OM-783.
BY-LAW read a first and second time this day of 1992.
BY-LAW read a third time and finally passed this day of
1992.
