THAT Report WD-16-92 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plans 1OM-799, 1OM-810 and 1OM-811; and 3 . THAT Council approve the by-laws attached to Report WD-16-92 assuming the streets within Plans 1OM-799, 1OM-810 and 1OM- 811 as public highways . ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2 : Road Assumption By-law for Plan 1OM-799 No. 3: Road Assumption By-law for Plan 1OM-810 No. 4 : Road Assumption By-law for Plan 1OM-811 REPORT NO. : WD-16-92 PAGE 2 2.0 BACKGROUND 2 . 1 On June 4, 1987, the Town entered into a subdivision agreement with Foster Creek Developments Limited to develop lands by plan of subdivision, located in Newcastle Village and described as Plans 1OM-799, 1OM-810 and 1OM-811 (Attachment No. 1) . The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works ' . 2 .2 The subdivision agreement allows the Works to be separated into two (2) stages: a) Initial Stage Works, (sewers and base roadworks) and, b) Final Stage Works, (boulevards, sidewalks and surface asphalt) 2 . 3 The Initial Stage Works for Plan 1OM-799 were completed and a 'Certificate of Completion' was issued December 1, 1987 . The Works were subsequently placed on a two (2) year maintenance period. 2 .4 The Initial Stage Works for Plans 1OM-810 and 1OM-811 were completed and a 'Certificate of Completion' was issued September 71 1988 . Those Works were subsequently placed on a two (2) year maintenance period. 2 .5 The Final Stage Works for all three (3) phases were completed simultaneously and a 'Certificate of Completion' was issued July 9, 1990 . These Works were placed on a one year maintenance period which expired July 9, 1991. I 2 . 6 All of ' the Works were subsequently re-inspected at that time and were found to be satisfactory. . . . /3 I ' 0 - 9 REPORT NO. : WD-16-92 PAGE 3 2 . 7 The culvert bridge and all associated works within Block 99 are not included in this report and will not be eligible for a 'Certificate of Acceptance' for at least two (2) years . 2 . 8 It is now appropriate to issue a 'Certificate of Acceptance' for all of the Works described, excluding the culvert and related works . The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2 . 9 Further to the issuance of a "Certificate of Acceptance' , by- laws are required to permit the Town to assume all the streets within Plans 1OM-799, 1OM-810 and 1OM-811 (Attachment Nos . 2, 3 and 4) . NOW THEREFORE, the 'Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets and reserve blocks described in Registered Plan 1OM-799 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. BY-LAW read a first and second time this day of 1992. BY-LAW read a third time and finally passed this day of 1992.
