THAT Report WD-20-92 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plans 1OM-790, 1OM-792, 1OM-805, 1OM-806 and 1OM-807; and 3. THAT Council approve the by-law attached to Report WD-20-92 assuming the streets within Plans 1OM-790, 1OM-792, 1OM-805, 1OM-806 and 1OM-807 as public highways . ------------------------------------------------------ REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2 : Road Assumption By-law'- for Plan 1OM-790 No. 3: Road Assumption By-law for Plan 10M-792 No. 4: Road Assumption By-law for Plan 1OM-805 /2 REPORT NO. : WD-20-92 PAGE 2 No. 5: Road Assumption By-law for Plan 1OM-806 No. 6 : Road Assumption By-law for Plan 1OM-807 2.0 BACKGROUND 2 . 1 On May 22, 1983, the Town entered into a subdivision agreement with Claret Investments Limited and Rexgate Holdings Limited to develop lands by plan of subdivision, located in Courtice and described as Plans 1OM-790, 1OM-792, 1OM-805, 1OM-806 and 1OM-807 (Attachment No. 1) . The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works ' . 2 .2 This particular subdivision agreement does not permit the separation of the Works into Initial and Final Stages . Instead, it provides for the issuance of a single 'Certificate of Completion' , to be issued upon the completion of all of the Works . 2 . 3 The final stage Works for Phases 1, 2, 3A, 3B and 4 were completed simultaneously and a 'Certificate of Completion' was issued dated October 31, 1989 . The Works were placed on a two (2) year maintenance period which expired October 31, 1991. 2 .4 All of the Works were subsequently re-inspected and were found to be satisfactory. 2 .5 It is now appropriate to issue a 'Certificate of Acceptance' for all of the Works . The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. j . . /3 I 100 2 i REPORT NO. : WD-20-92 PAGE 3 2 . 6 Further to the issuance of a "Certificate of Acceptance' , a by-law is required to permit the Town to assume all the streets within Plans: 1OM-790, (Attachment No. 2) 1OM-792, (Attachment No. 3) 1OM-805, (Attachment No. 4) 1OM-806, (Attachment No. 5) 1OM-807, (Attachment No. 6) . Q(-1 4 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92- Being a By-Law to assume certain streets within the Town of Newcastle as public highways in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets and road widening described in Registered Plan- IOM-790 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Town of Newcastle, in the Regional- Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the Istreets and road widening on Plan 1OM- 790. BY-LAW read a first and second time this 24th day of February, 1992. BY-LAW read a third time and finally passed this 24th day of February, 1992. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the lands described as Blocks 73, 75 and 77, Plan 10M- 792, in the Town of Newcastle, Regional Municipality of Durham, are hereby established, laid out, dedicated as public highway and assumed by the said Corporation for public use. 2. THAT the streets described in Registered Plan 1OM-792 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted. by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 3. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-792. THAT the lands described as Block 66, Plan 10M-806, in the Town of Newcastle, Regional Municipality of Durham, are hereby established, laid out, dedicated as public highway and assumed by the said Corporation for public use. 2. THAT the streets and Blocks 64 and 65 described in Registered Plan 1OM-806 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Town of •Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. THAT the streets and Blocks 76, 78 and 79 described in Registered Plan 1OM-807 (described in Schedule "A" attached hereto and forming part of this By-law), all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use.
