Subject: PROHIBITION OF SCHOOL BUS PARKING ON RESIDENTIAL STREETS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-26-92 be received; and
2 . THAT no changes be made to the Consolidated Traffic By-law 91-
58 in respect to the existing prohibition from residential
streets of heavy vehicles which includes school buses .

2.0 BACKGROUND
2 . 1 At a regular meeting held on February 3, 1992, Council passed
Resolution #GPA-120-92:
"THAT the By-law Officer consider an amendment
FORTHWITH to the Traffic By-law which would
allow school buses to park on a street in a
residential area for a maximum of three hours,
Monday to Friday, during the hours of 9 :00
a.m. to 4:00 p.m. ; and

positive and negative impacts of this
amendment. "
3.0 REVIEW AND COMMENT
3. 1 Existing Zoning By-law 84-63
The Town of Newcastle Zoning By-law 84-63, 3 . 14 (f) states:
"Within any Residential Zone, the owner or
occupant of a dwelling unit may use a parking
space for the purposes of the parking or
storage of one commercial motor vehicle, as
defined under the Highway Traffic Act, as
amended, provided that the gross vehicle
weight, at capacity, does not exceed four (4)
tonnes . "
A full size school bus has a registered gross weight of 5 .45
tonnes and, under the terms of the Zoning By-law, is not
allowed to park on private property in residential zones .
Prior to the revisions of Traffic By-law 79-1, truck and bus
drivers could avoid the zoning restrictions by moving the
vehicle onto the street.
3 .2 . Existing Traffic By-law 91-58
The Town of Newcastle Consolidated Traffic By-law 91-58 was
approved by Council on April 8, 1991 . Report WD-32-91
specifically stated that this was a new section not covered
by previous traffic by-laws . Section 4 (3) states:
"No person shall park a commercial motor
vehicle which exceeds 2 . 6 metres in width or
7 metres in length or having a vehicle weight
in excess of 5,000 kilograms on any highway,
except in an industrial area, unless such

vehicle is actually engaged in the loading or
unloading of goods, wares, merchandise or passengers
to adjacent premises. "
If Council were to make an exception for school buses it would
be added to this section (see Attachment No. 3) .
3 .3 Comparison With Other Municipalities
The Region of Durham, City of Oshawa and Town of Pickering all
have traffic by-laws which prohibit heavy vehicles from
parking on residential streets and do not provide exemptions
for school buses . The Towns of Ajax and Whitby do not have
by-laws to restrict heavy vehicles other than the three (3)
hour limit for all vehicles . The policy at the Towns of
Whitby and Ajax is to telephone the bus lines and ask for
their co-operation in moving the vehicles. The bus lines have
been co-operative and request the drivers to relocate the
vehicles .
3 .4 Enforcement by Town of Newcastle
The Town of Newcastle By-law Enforcement Department receives
numerous complaints of heavy vehicles and school buses. The
By-law Enforcement Officers enforce Section 4 (3) of the
Consolidated Traffic By-law on a complaint basis .
3 .5 Positive Impacts
Convenience for Bus Drivers
Providing an exemption for school buses will allow drivers to
bring their vehicles home for the majority of the day without
having to return it to the bus line depot and exchange
vehicles .

3 . 6 Negative Impacts
Increased Complaints
If school buses are exempted, more drivers will bring their
vehicles home and anger their neighbours thereby increasing

complaints related to safety and appearance (Attachment No.
3) .
Discrimination
If school buses are exempted, while smaller commercial
vehicles are prohibited, it will create an unfair situation
for truck drivers.
Interference With Traffic Flow and Safety
Large vehicles cause visibility problems and interfere with
traffic flow.
3 .7 ' Perimeter Parking Regulation Signing
The Town of Newcastle Public Works Department, in co-operation
with the Region of Durham Public Works Department, has
purchased signs to be installed at the main entrances of
Bowmanville, Newcastle Village, Orono and Courtice (Attachment
No. 2) . These signs are similar to those posted in Oshawa.
4.0 CONCLUSIONS
4 . 1 From the above, it is concluded that no changes should be made
to the Consolidated Traffic By-law 91-58 in respect to the
prohibition of heavy vehicles, which includes school buses
from residential streets .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 92-
Being a By-law to amend By-law 91-58 being a
By-law to Regulate Traffic on Highways,
Municipal and Private Property in The
Corporation of The Town of Newcastle.
WHEREAS the Council of The Corporation of The Town of Newcastle
deems it desirable to amend By-law 91-58;
NOW THEREFORE the Council of The Corporation of the Town of
Newcastle enacts as follows:
1. General Parking and Stopping Regulations, Section 4, Item 3,
of By-law 91-58 is hereby amended by:
(a) Deleting Section 4, Item 3:
"No person shall park a commercial motor vehicle
which exceeds 2.6 metres in width or 7 metres in
length or having a vehicle weight in excess of 5,000
kilograms on any highway, except in an industrial
area, unless such vehicle is actually engaged in the
loading or unloading of goods, wares, merchandise
or passengers to adjacent premises. "
(b) Substituting the following:
Section 4, Item 3 (A)
No person shall park a commercial motor
vehicle which exceeds 2.6 metres in width or
7 metres in length or having a vehicle weight
in excess of 5,000 kilograms on any highway,
except in an industrial area, unless such
vehicle is actually engaged in the loading or
unloading of goods, wares, merchandise or
passengers to adjacent premises.
Section 4, Item 3 (b)
Notwithstanding (a) above, school buses may
park on a street in a residential area for a
maximum of three (3) hours, Monday to Friday,
during the hours of 9:00 a.m. to 4:00 p.m.
By-law read a first and second time this 23rd day of March, 1992.
By-law read a third time and finally passed this 23rd day of March,
1992.
