Subject: OVERSIZING OF STORM SEWERAGE FACILITIES
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-32-92 be received; and
2 . THAT Mr. J. C. Simmonds be advised that The Corporation of The
Town of Newcastle does not wish to participate in a study to
develop a cost sharing policy for storm sewerage facilities
related to plans of subdivision.

2.0 BACKGROUND
2 . 1 At a meeting held on October 15, 1991, Council considered a
letter dated September 25, 1991, from Mr. J. C. Simmonds,
Director of Engineering, The Corporation of The City of
Oshawa, and passed Resolution #C-625-91:
"THAT the correspondence dated September 25, 1991, from
J. C. Simmonds, Director of Engineering, The Corporation
of The City of Oshawa, regarding the oversizing of storm
sewerage facilities related to plans of subdivision, be
received;
THAT the correspondence be referred to the Director of
Public Works for review and preparation of a report to
be submitted to the General Purpose and Administration
Committee; and
THAT J. C. Simmonds be advised of Council's decision. "
3.0 REVIEW AND REPORT
3 . 1 With the passing of Development Charge By-laws, most
municipalities in the province will require a policy for cost
sharing for storm sewerage facilities related to subdivisions .
Since it is a common requirement, The Corporation of The City
of Oshawa suggested that the city, in conjunction with area
municipalities, invite consulting firms to submit proposals
for undertaking a detailed analysis for the establishment of
a storm drainage facility cost sharing policy.

3.2 Unfortunately, because of pressure from developers to prepare
subdivision agreements, The Corporation of The Town of
Newcastle has proceeded to develop such a policy. Therefore,
it is felt that to participate in the proposed study by The
Corporation of The City of Oshawa would be redundant.

3 . 3 This matter has been discussed with Mr. Simmonds and he has
been advised that we will share with him our method of dealing
with the problem when it is available.

OVERSIZING OF STORM SEWERAGE FACILITIES RELATED TO PLANS OF SUBDIVISION
Please find attached a copy of the Director of Public Works' Report Item No. 133-91 dated
1991 08 28. The report outlines the current City of Oshawa policy for the oversizing of
storm sewerage facilities: related to .plans of -subdivision, changes anticipated by
implemerttation of The Development Charges Act, 1989, and a recommendation that
consulting firms be invited to submit proposals for undertaking a detailed analysis for the
establishment of a storm drainage facility cost sharing policy.
The Director of Public Works' Report was adopted by the Public Works Committee on
1991 08 28. At that meeting, the Committee requested that staff contact other area
municipalities to determine if they would be interested in participating in the study.
Please review the attached report and advise if your municipality has any interest in jointly
participating and cost sharing in the proposed study. If you require .any additional

City of Oshawa policy for the oversizing of storm sewerage facilities to accommodate
upstream drainage 4T2
RECOMMENDATION
1. That the proposes: action with respect to the oversizing of storm drainage facilities
as outlined in the Director of Public Works' report on Item No. 133-91 dated
1991 08 28 be approved.
2. That a copy of the Director of Public Works' report dated 1991 08 28 on Item No.
133-91 be forwarded to the Central Lake Ontario Conservation Authority.
REPORT
The present City of Oshawa storm sewer policy for subdivisions requires that a subdivider
of land construct storm sewerage facilities of sufficient size to accommodate all of the
upstream drainage area. The existing policy makes no provision for cost sharing the
oversizing.
The Development Charges Act, 1989, will reduce the.:municipality's ability to require the
oversizing of storm sewers and drainage ponds within plans of subdivision, and the
construction of ponds external to plans of subdivision as a condition of the subdivision
agreement. The City's consultant for the study on development charges, C.N. Watson and
Associates Ltd., in their draft report dated 1991 07 05 have noted that if it were possible
for the municipality to anticipate all such costs and to incorporate them into the
development charge, that would be the solution. However, it also notes that there are
difficulties carrying out such a costing exercise in advance of the necessary engineering
work being completed. In the circumstance, the consultant has suggested that the City
investigate various options/alternatives for the financing and administration of both storm
drainage facilities and the oversizing of storm sewers.
The matter of cost sharing for the oversizing of storm sewerage facilities (storm sewers
and ponds) is a complex issue and will require a detailed review and analysis. It is proposed
that as a first step in this process, the City invite proposals from a minimum of three
consulting engineering firms. The consultants will be requested to prepare a proposed
terms of reference, a detailed outline of the process intended to be followed, the time
frame and the cost to carry out the assignment.

The second step would be the evaluation of the three proposals by a Technical Co-ordinating
Committee for the project, and a further report to the Public Works Committee with the
intent of recommending that one of the consultants be retained for this project. . The
Technical Co-ordinating Committee would include representation from the Central Lake
Ontario Conservation Authority and the City's Planning and Development, Community
Services and Public Works Departments, with a representative of the Public Works
Department performing the role of Chairperson.
The direction to the consultants for submission of proposals would require that the terms of
reference detail their approach to the study. As a minimum, the consultant's proposal will
have regard for the City's storm sewer design criter��G� ;;�a�:siorm water management
poifefes, the Ministry of Natural Resources and Department of Oceans and Fisheries storm
water management policies with respect to fish habitat and ground water recharge, together
with a review of storm sewer cost sharing policies of other municipalities of similar size,
geographic location and geomorphic conditions.
The consultants will be required to evaluate cost sharing alternatives utilizing. existing plans
of subdivision and to consider the impact, if any, on the resources of the City.
The report resulting from the study will recommend a preferred alternative together with
guidelines for the preparation of a policy and procedure.

The Chairman referred to the report of the Director of Public Works on this item.
Councillor Diamond noted that with the enactment of the Development Charges Act,
other municipalities will possibly experience the same difficulties with requiring
subdividers to provide oversizing of storm sewer and drainage ponds in their plans of
subdivision. She suggested that staff contact other area municipalities to determine if
they would be interested in a joint cost sharing for the project by the consultant who will
be retained for the study.
