Subject: REMIARK SUBDIVISION, COURTICE
PLAN 1OM-781 AND ADJACENT REGISTERED PLANS,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ,
ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS
AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-33-92 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage
system, street lights and other related works, constructed
within Plan 1OM-781 and within all adjacent plans noted; and
3 . THAT Council approve the by-laws attached to Report WD-33-92
assuming the streets within Plan 1OM-781 and within all
adjacent plans noted, as public highways .

2.0 BACKGROUND
2 . 1 On June 18, 1986, the Town entered into a subdivision
agreement with Kingsberry Properties to develop lands by plan
of subdivision, located in Courtice and described as Plan 1OM-
781 (Attachment No. 1) . The agreement required the developer
to construct all roadworks, including hot-mix paving, curb and
gutter, sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works ' .
2 .2 In association with this development, Kingsberry Properties
developed additional adjacent lands through the land division
process .
2 .3 The required Works for the subdivision and adjacent land
divisions were completed simultaneously and a 'Certificate of
Completion' was issued June 30, 1990 . The Works were placed
on a one year maintenance period which expired June 30, 1991.
2 .4 All of the Works were subsequently re-inspected and were found
to be satisfactory.
2 .5 It is now appropriate to issue a 'Certificate of Acceptance'
for all of the Works described. The subdivision agreement
provides for this certificate to be issued by the Director of
Public Works, subject to the approval of Council.
2 . 6 Further to the issuance of a 'Certificate of Acceptance' , two
(2) by-laws are required. The first by-law (Attachment No.
2) will permit the Town to dedicate those lands which have not

yet been dedicated and the second by-law (Attachment No. 3)
will accept and assume for public use, the dedicated lands .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 92-
Being a By-Law to establish and lay out
certain streets within the Town of Newcastle
as public highways.
NOW THEREFORE, the Council of The Corporation of The Town of
Newcastle enacts as follows:
1. THAT the lands described in Schedule "A" attached hereto and
forming part of this By-law, all being located in the Town of
Newcastle, in the Regional Municipality of Durham, are hereby
established and laid out as public highways.
2. THAT the Clerk be authorized to apply to the Land Registry
Office to have The Corporation of The Town of Newcastle shown
as the owner of the streets on Plan 10M-781.
BY-LAW read a first and second time this 13th day of April, 1992.
BY-LAW read a third time and finally passed this 13th day of April,
1992.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 92-
Being a By-Law to assume certain public
highways within the Town of Newcastle as
public highways.
NOW THEREFORE, the council of The Corporation of The Town of
Newcastle enacts as follows:
1. THAT the public highways more particularly described in
Schedule "A" attached hereto and forming part of this By-law,
all being located in the Town of Newcastle in the Regional
Municipality of Durham, are hereby accepted by The Corporation
of The Town of Newcastle as public highways, and assumed by
the said Corporation for public use.
BY-LAW read a first and second time this 13th day of April, 1992.
