By-Law# Report#:__WD_-_39_-92_ File#: RC_3J_AZ Subject: EXPROPRIATION OF LANDS FROM MANUFACTURER'S LIFE ASSURANCE COMPANY (MANULIFE) FOR THE WIDENING OF HIGHWAY 2, BOWMANVILLE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-39-92 be received; 2 . THAT appropriate Town Officials take the necessary action to initiate and prosecute expropriation of the necessary land from Manulife for the widening of Highway 2 (King Street) , Bowmanville; 3. THAT the necwessary by-law to commence the expropriation process be passed by Council; and 4 . THAT Messrs . Tory, Tory, DesLauriers and Binnington, be advised of Council's decision. ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Map 2.0 BACKGROUND 2 . 1 The reconstruction of Highway 2 (King Street) from Simpson Avenue easterly to the bridge over the Soper Creek and of Mearns Avenue from King Street northerly to orchard Park Drive . . . /2 REPORT NO. : WD-39-92 PAGE 2 is scheduled for 1993 in the approved 1992 Capital Budget and Four Year Forecast. 2 .2 This project requires the purchase of land on the east and west sides of Mearns Avenue and on the south side of King Street east as illustrated on Attachment No. 1. The land from John and Carol Sornberger has been purchased, and an agreement has been reached with Sibjel Investments Limited. 2 .3 In March, 1991, Council approved proceeding with expropriation of the land required on the east side of Mearns Avenue from the owners of the Bowmanville Zoo. That expropriation is now in progress . 3.0 REVIEW AND COMMENT 3 . 1 At the time of proceeding with the expropriation from the owners of the Bowmanville Zoo, we thought we had an agreement with Manulife; however, although we feel we have agreed to all of their requirements, we are unable to obtain an Offer to Sell from Manulife. 3 .2 In order to be in a position to proceed with the reconstruction of King Street and Mearns Avenue in 1993, it is now necessary to proceed with expropriation from Manulife for the widening required.
