Subject: AUTHORIZATION TO EXECUTE A SERVICING AGREEMENT BETWEEN
VELTRI AND SONS CORPORATION AND THE TOWN OF NEWCASTLE
REGARDING THE DEVELOPMENT OF LAND DIVISION APPLICATIONS
LD 91/137 TO LD 91/140
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-42-92 be received;
2 . THAT Council pass the attached By-law to Report WD-42-92
(Attachment No. 3) which authorizes the Mayor and Clerk to
execute a Servicing Agreement between the Corporation of The
Town of Newcastle and Veltri and Sons Corporation, for the
servicing of Land Divisions 91/137 to 91/140, at such time as
an agreement has been prepared to the satisfaction of the
Director of Public Works; and
3. THAT Mr. Mario Veltri of Veltri and Sons Corporation be
advised of Council's decision.

2.0 BACKGROUND
2 . 1 Mr. Mario Veltri, representing Veltri and Sons Corporation,
has made application to the Land Division Committee for the
development of lands as shown on Key Map (Attachment No. 1)
and described as LD 137/91 to LD 140/91. The development of
these lands will require the extension of McFeeters Avenue and
includes road works, storm sewers, sidewalks and street trees .
2 .2 The Town of Newcastle was circulated on these Land Division
Applications and staff's recommendations to the Land Division
Committee, dated 2 July 1991 (Attachment No. 2) , which form
the conditions of approval, are as shown in Comments to Land
Division Committee Meeting for July 8, 1991.
2 . 3 In order for the applicant to be granted approval of the Land
Division Applications, the Town of Newcastle must advise the
Land Division Committee that all of the conditions of approval
have been satisfied. Recommendation No. 10, which requires
the applicant to enter into a Development Agreement for the
servicing of the proposed severances, must be satisfied.
2 .4 A Servicing- Agreement has been prepared between the
Corporation of the Town of Newcastle and Veltri and Sons
Corporation to satisfy Recommendation No. 10 . However, in
order to clear Recommendation No. 10 of the conditions of
approval, a by-law must be passed to authorize the Mayor and
Clerk to execute such an agreement.

COMMENTS TO LAND DIVISION COMMITTEE MEETING FOR JULY 8 1991

PROPOSED USE. RESIDENTIAL
CONFORMITY WITH OFFICIAL PLAN PROVIS IONS:
Within the Durham Regional Official Plan the subject property is designated as
"Residential". The predominant use of lands within such a designation shall be for
residential purposes.
CONFORMITY WITH ZONING BY-LAW PROVISIONS:
Within the Town of Newcastle Comprehensive Zoning By-law 84-63, as amended, the
subject property is zoned "Urban Residential Type One (111)". The subject zone permits
single family dwelling units on lots having a minimum frontage of 15 metres and semi
detached/link lots with a minimum frontage of 18 metres.
COMMENTS:
The applicant intends to sever the subject property and along with other lands external
to the subject property, develop the total holdings with six (6) semi detached/link units,
one single family dwelling unit and two blocks for future development. In addition, the
proposed severances will facilitate approximately a 47 m (154 ft.) extension of
McFeeters Crescent from the existing-limits north of Downham Drive. A related land
severance LD 394/90 was approved in February of 1991 and is yet to be perfected. In
that application, the proponent severed the existing dwelling while retaining the balance
of the lands now subject to applications.
RECOMMENDATIONS:
Should the Committee deem it appropriate to approve the application, Staff would have
no objection, however, would request.that, as conditions of approval the applicant be
required to:
1. provide Staff with three copies of the 1011 plan;
2. meld Block 18 of Draft approved 18T-89086 with the abutting property directly
to the north;
3. satisfy the Director of Public Works, financially and otherwise;
4. pay to the Town of Newcastle the appropriate lot development charges as
amended from time to time;

5. provide a cash payment to the Town of Newcastle in lieu of parkland dedication;
6. deposit with the Town, in the amount of $1,000. per lot as Performance
Guarantee for grading and drainagework. Said deposit will be refunded to the
applicant when all grading and drainage works are completed to the satisfaction
of the Director of Public Works;
7. submit for the approval by the Director of Public Works, a Lot Grading and
Drainage Plan to L s prepared by an Engineer or Surveyor in accordance wiih the
Town's standards prior to final clearance for consent by the Town;
8. register on title:
THAT the Owner shall provide an Engineering Certificate certifying that the site
grading and .drainage have been completed in accordance with the approved
plan prior to the occupancy of said dwelling."
9. that any new lots created through severance, whether retained or severed comply
with applicable provisions of zoning By-law 84-63.
10. that the applicant/owner enter into'a development agreement with the Town of
Newcastle for the proposed extension to McFeeters Crescent and that the
applicant satisfy the Director of Public Works with respect to all requirements
related to said construction.
11. that all works to be undertaken are completed in compliance with the standard
design principles of the Town.
12. that the applicant dedicate to the Town a 3.05 m road widening along -Mearns
Aver on the severed and retained parcels.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 92-
Being a By-law to authorize the entering into
of a Servicing Agreement between Veltri and
Sons Corporation and the Corporation of the
Town of Newcastle, pursuant to Land Division
Applications LD 91/137 to LD 91/140.
NOW THEREFORE the Council of the Corporation of the Town of
Newcastle hereby enacts as follows:
1. THAT the Mayor and Clerk are hereby authorized to execute on
behalf of the Corporation of the Town of Newcastle, and seal
with the Corporation's seal, . a Servicing Agreement between
Veltri and Sons Corporation and the said Corporation, pursuant
to Land Division Applications LD 91/137 to LD 91/140.
2. THAT the Mayor and Clerk are hereby authorized to accept, on
behalf of the Town, the said conveyances of lands required
pursuant to the aforesaid Agreement.
BY-LAW read a first and second time this 27th day of April, 1992.
BY-LAW read a third time and finally passed this 27th day of April,
1992.
