THAT Report WD-54-92 be received; 2 . THAT the By-law to amend By-law 91-58, Schedule XXX, (Attachment No. 2 to Report WD-54-92) , be passed by Council to designate the existing disabled person parking spaces in the Division Street and Fitness Centre Parking Lots, Bowmanville; 3. THAT the By-law to amend By-law 91-58, Sections 4 and 22, (Attachment No. 3 to Report WD-54-92) , be passed by Council to clearly indicate existing exemptions and limitations for disabled person parking permits; 4 THAT the By-law to amend By-law 91-58, Schedule XXIX, (Attachment No. 4 to Report WD-54-92) , be considered by Council and passed, if desired, to create a designated disabled persons parking space at 11 Temperance Street, Bowmanville; and 5 THAT Mr. Philip Palmer, Immediate Past Rector's Warden, St. John's Anglican Church, be advised of Council's decision. /2 REPORT NO. : WD-54-92 PAGE 2 REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2: Proposed By-law to amend By-law 91-58, Schedule XXX, "OFF-STREET PARKING FOR DISABLED PERSONS" No. 3: Proposed By-law to amend By-law 91-58, Sections 4 and 22, with respect to disabled persons No. 4: Proposed By-law to amend By-law 91-58, Schedule XXIX, "ON-STREET PARKING FOR DISABLED PERSONS" at 11 Temperance Street, Bowmanville No. 5: Design guidelines for disabled person parking No. 6: Information for Holders of Disabled Parking Permits 2.0 BACKGROUND 2 . 1 The Anglican Church at 11 Temperance Street, Bowmanville, has added a ramp for handicapped people, as well as expanding their facility to include a fully accessible washroom. On several occasions Mr. Philip E. Palmer has been in touch with staff of the Town requesting that the Town designate an on- street disabled person parking space on Temperance Street at the foot of the ramp. 3.0 REVIEW AND COMMENT 3 . 1 Before they had received a grant for construction of a disabled person washroom and an access ramp, the Church had made a similar request in 1990. At the time, it was suggested that they provide off-street disabled person parking at the rear of the church. The parking area is accessible from the . . . /3 i REPORT NO. : WD-54-92 PAGE 3 driveway at 124 Queen Street and could be upgraded with an asphalt pad, together with a concrete sidewalk, beside the Church to fully provide for disabled persons . 3.2 The Consolidated Traffic By-law currently provides assistance to disabled persons by providing the following exemptions: a) Payment of fees for on-street and off-street parking meters; b) Three (3) hour parking limits, (maximum stay 24 hours) ; and i c) Scheduled no parking zones . With these exemptions there are two (2) locations on Temperance Street between the Anglican Church and Ring Street, (as shown on Attachment No 1) , where disabled persons may park if the metered spaces are in use. The Traffic By-law provides Bowmanville with a total of four (4) designated on- street parking spaces, two (2) on Church Street at the Municipal Administrative Centre and two (2) on Prince Street at Bowmanville Memorial Hospital. Two (2) off-street parking spaces in the Division Street Parking Lot and two (2) spaces in the Fitness Centre Parking Lot, which have existed for several years, were omitted from the original schedule but will be included with the by-law amendment (shown as Attachment No. 3) . Although the exemptions noted above exist in current by-law 91-58, the by-law amendment shown as Attachment No. 4 will clarify and expand upon the exemptions and limitations. i . . . /4 I V6 i REPORT NO. : , WD-54-92 PAGE 4 3 . 3 Other municipalities in the Region of Durham rely on similar exemptions as noted in 3.2 above, but do not encourage designating on-street disabled person parking for a number of reasons, namely: a) A designated on-street disabled person parking space eliminates available parking for downtown businesses and the general public as turnover in designated parking spaces is very slow with spaces being vacant a large portion of the time; b) Exemptions, as noted in 3 .2 above, provide greater flexibility for disabled persons to park closer to their destination; c) It is difficult to determine parking demand for a specific location to assist the greatest number of disabled persons . Typically, the designated spaces should provide access to a number of commercial, medical or government buildings where off-street parking is not available; and d) Not designating on-street disabled person parking spaces encourages safer off-street parking on municipal or private property. The Town of Whitby has two (2) designated on-street locations while Oshawa, Ajax, Pickering and the Region of Durham have none. 3.4 The decision to designate on-street parking for disabled persons is a local responsibility. If Council wishes to have . . . /5 i I REPORT NO. : WD-54-92 PAGE 5 the parking meter removed and designate the location at 11 Temperance Street as a disabled persons parking space the required by-law is shown as Attachment No. 4 . 3 .5 The City of Oshawa, which has worked closely with the Ontario Traffic Conference and the Government of Ontario - Office for Disability Issues, has developed a set of Technical Guidelines and Standards for the Design of Parking Spaces to Serve Disabled Persons (Attachment No. 6) , which could be used as a guide. The installation of disabled persons parking spaces on private property within the Town of Newcastle is negotiated during the site plan agreement. 4.0 CONCLUSIONS 4 . 1 From the above it is concluded that By-laws shown as Attachments Nos . 2 and 3 should be passed by Council to amend the Consolidated Traffic By-law 91-58 with respect to disabled persons parking. 4 .2 Council should, at its discretion, pass the By-law shown as Attachment No. 4 to create a designated on-street disabled person parking space at 11 Temperance Street, Bowmanville. NOW THEREFORE the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Schedule XXX, "OFF-STREET PARKING FOR DISABLED PERSONS", of By-law 91-58 is amended by: a) Adding the following references: Column 1 Column 2 Location Number of Stalls Division Street Parking Lot 2 (Bowmanville) Fitness Centre Parking Lot 2 2. MAYOR i CLERK ATTACHMENT NO. 2 l WD-54-92 CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 92- Being a By-law to amend By-law 91-58, being a By-law to Regulate Traffic on Highways, and Municipal and Private Property in the Town of Newcastle WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to amend By-law 91-58. NOW THEREFORE the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 4, "GENERAL PARKING AND STOPPING REGULATIONS" , of By- law 91-58 is amended by: a) Deleting subsection (11) ; (11) (A) and (11) (B) in its entirety. 2. Section 22, "ON-STREET AND OFF-STREET PARKING FOR DISABLED PERSONS", of By-law 91-58 is amended by: b) Subsections (1) to (6) inclusive to be deleted in its entirety and substituted with the following: 22. (1) A designated parking space on Municipal or Private Property shall be distinctly identified by an Official Sign in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder and this by-law. (2) Designated parking spaces: (a) On Municipal streets and highways are described in Schedule XXIX; (b) On Municipal parking lots are described in Schedule XXX; and (c) On private property where distinctly identified by an Official Sign in accordance with the requirements of the Highway Traffic Act and this by-law. 3. The driver or operator of a vehicle which displays a permit in accordance with the requirements of the Highway Traffic Act and the regulations made thereunder and this by-law shall not be required to pay an amount in excess of the normal fee paid by other users of the same parking lots or other parking facilities to which the public has access. 4. No person or organization shall park a vehicle in a designated parking space, or be entitled to an exemption under this by-law, unless a currently valid permit has been issued to that person, organization or to passenger being picked-up or transported in the vehicle and such permit is displayed on or in the vehicle in accordance with the requirements of the Highway Traffic Act, the regulations made thereunder, and this by-law. 5. Disabled person parking permit exemptions: Notwithstanding the provisions of any section of this by-law, a vehicle properly displaying a disabled person parking permit is hereby ATTACHMENT NO. 3 /2 I J 7 I WD-54-92 2 - exempt from the following provisions of this by-law: (a) Section 4 (6) (I) with respect to three hour parking limits; (b) Section 6 (1) with respect to Schedule II, Scheduled No Parking Zones, and Section 6 (2) with respect to Schedule III, Parking For Restricted Periods; and (c) Section 9 (2) with respect to payment to park at a parking meter located on a highway or in a municipal parking lot. 6. Notwithstanding the provisions of any section of this By-law, a vehicle properly displaying a disabled person parking permit is hereby permitted to park one (1) vehicle immediately adjacent to the open end of a row of parking spaces when no other location is readily available. 7. Limitations of parking permit exemptions: It shall constitute an offence for a.person who owns or operates a vehicle on which a permit is displayed in accordance with the requirements of the Highway Traffic Act and this by-law to park said vehicle: (a) On any highway or municipal parking lot for a period longer than twenty-four (24) hours; and (b) On any highway in such a manner as to interfere with the movement of traffic public safety or the clearing of snow from the highway. THAT this By-law shall come into force and take effect on the date of the passing thereof. BY-LAW read a first and second time this 13th day of July, 1992. MAYOR I i CLERK ATTACHMENT N0, 4 WD-54-92 I i TECHNICAL GUIDELINES AND STANDARDS FOR THE DESIGN OF PARKING SPACES TO SERVE DISABLED PERSONS A designated parking space reserved for the sole use of a vehicle operated by or carrying a physically disabled person should be: 1. Hard surfaced. 2. Level (avoid slopes) . 3. A minimum width of 4.1 metres (13.5 feet) . This space is required for the safe deployment of lifts and ramps of a vehicle which has been modified for disabled persons. The designated parking space could be located at the "open end" of a row of spaces in order to provide the necessary clearance. In this case, a parking space of normal width may be sufficient, particularly if the adjacent space is protected from infringement. 4. A minimum length of 5.4 metres (18 feet) . 5. A minimum vertical clearance of 2.75 metres (9 feet) . 6. Located so sidewalks, paths, etcetera will be accessible to physically disabled persons whether via ramps, aisles, depressed curbs, or other appropriate means without requiring a person to pass behind parked cars or cross a traffic lane. 7. Located with sufficient clearance around the vehicle, in terms of other vehicles, or obstacles such as light standards, waste receptacles, etcetera, to permit free access by wheelchair. 8. Identified by the official sign required by the Highway Traffic Act regulations. This sign should be mounted with the base of the sign a minimum of 1.7 metres (5.6 feet) above ground level. The universal symbol of access may be painted on the pavement as an ancillary notice but by itself would not consitute official signage. 9.
