Subject: REQUEST FOR ROAD CLOSURE AND CONVEYANCE OF A PORTION OF THE
UNOPENED ROAD ALLOWANCE BETWEEN LOTS 26 AND 27 IN CONCESSION
1, FORMER TOWNSHIP OF DARLINGTON - PART 1, UNREGISTERED PLAN
APEX ENGINEERING CONSTRUCTIONS INC. AND WING HANG CORPORATION
LTD.
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-65-92 be received;
2 . THAT staff be authorized to advertise a public hearing
required by the Municipal Act for the closure and conveyance
of part of the unopened road allowance between Lots 26 and 27,
Concession 1, former Township of Darlington;
3 . THAT, if following such Hearing Council decides to close and
authorize the conveyance of the subject road allowance to Apex
Engineering, the Mayor and Clerk be authorized to execute the
necessary documents to complete the transaction;
4 . THAT Council defer the passing of the necessary by-law until
the Town has received compensation for the conveyance
established at a value of $9,600, plus all associated costs;

5 . THAT the applicant execute an Indemnity Agreement with the
Town satisfactory to the Town's solicitor prior to the passing
of the necessary by-law;
6 . THAT the Town's solicitor be directed to take all actions
necessary to complete the transactions; and
7 . THAT Mr. Bob Annaert, D. G. Biddle and Associates, be advised
of Council's decision.

2.0 BACKGROUND
2 . 1 Apex Engineering Constructors Inc. and Wing Hang Corporation
have submitted a Site Plan Application to the Planning and
Development Department for approval. Through the circulation
process, the Canadian Pacific Railway and the Public Works
Department identified concerns regarding the original proposed
intersection at Baseline Road. C.P. Rail expressed concern
regarding the proximity of the original intersection to the
railway crossing. The Public Works Department shared this
concern. The applicant agreed to relocate the intersection.
The proposed revision and realignment of the intersection
(Attachment #2) adjusts the intersection 23 metres to the
east.

2 .2 Realignment of the intersection as proposed caused a small
portion of the unopened road allowance to remain between the
intersection and the applicant's property. The best use of
the property is considered to be additional land with the
abutting parcel to the west.
2 .3 The applicant made application for closure and conveyance of
the portion of the unopened road allowance on May 28, 1991.
3.0 CIRCULATION
3 . 1 The road closing application was circulated to all
departments, agencies and authorities. The Ministry of
Transportation originally expressed concern that the proposed
realignment of the intersection would interfere with the
proposed technically preferred route for the Oshawa/Newcastle
Freeway Link (Highway 407) . The Ministry of Transportation's
concerns have been resolved. Attached is correspondence from
the M.T.O. stating they have no objection to the proposed
realignment.
4.0 APPRAISAL
4 . 1 Durham Appraisal Services Inc . completed an Appraisal Report
on the subject property and determined Market Value at $9,600
($56,000 per acre) .
5.0 COMPENSATION
5 . 1 The subject property is 1,906 metres x irregular depth. The
site area is 723 square metres (7,782 square feet) .
The site being developed adjacent to the road allowance is
zoned General Industrial (M2) .

The value of the land was calculated as follows:
Area of subject site = 723 square metres (7,782 sq. ft. )
7,782 sq. ft. x 1.23 per sq. ft. _ $ 9,572
Rounded to $ 9,600
6.0 RECOMMENDATIONS
6 . 1 That part of the unopened road allowance between Lots 26 and
27, Concession 1, former Township of Darlington, be closed and
conveyed to Apex Engineering Constructors Inc . and Wing Hang
Corporation Ltd. , at the selling price of $9,600 and all
associated costs in accordance with Town Policy, provided the
applicant satisfies all conditions of the road closing
procedure.

We have no objections to the above mentioned application since it does not affect our proposed technically
preferred route, or any of the alternative routes for the Oshawa/Newcastle Freeway Link. Please find the
attached memorandum from our consultant undertaking the Oshawa/Newcastle Freeway Link Study.

SUBJECT: Development Application
Application to close and convey Hancock Road at Baseline
Road (Municipal's File No. : D1.26.03).
With reference to the above application, a portion of Hancock Road at the
junction with Baseline Road is proposed to be realigned. We have reviewed
the proposal and noted that the proposed realignment is close to the freeway-
to-freeway interchange of the technically preferred route with Highway 401.
At Baseline Road, the crossing would be grade-separated with the link
crosses above the at-grade Baseline Road. At this point of the study, we do
not see any conflict of the proposed realignment with the technically
preferred route, as long as the proposed realignment is outside the envelope
of the freeway to freeway interchange.
