Report#: File #: 1 By-Law# Subject: REQUEST FOR CLOSURE OF A PORTION OF MARTIN ROAD - PART OF THE ROAD ALLOWANCE BETWEEN LOTS 14 AND 15 CONCESSION 1, FORMER BOWMANVILLE - ASPEN SPRINGS, TOWN OF NEWCASTLE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-72-92 be received; 2 . THAT staff be authorized to advertise a public hearing required by the Municipal Act for the closure to vehicular traffic of the road allowance between Lots 14 and 15, Concession 1, former Bowmanville; 3. THAT if, following such Hearing, Council decides to close to vehicular traffic the subject road allowance, the Mayor and Clerk be authorized to execute the necessary documents to complete the closure; 4. THAT the applicant execute, prior to the passing of the necessary by-law, an Indemnity Agreement with the Town satisfactory to the Town's solicitor; 5 . THAT the Town's solicitor be directed to take all actions necessary to complete the closure; 6 . THAT Council defer the passing of the necessary by-law until the Town has received payment for all estimated costs associated with the road closure; and /2 REPORT NO. : WD-72-92 PAGE 2 7 . THAT Mr. Kelvin Whalen, The Kaitlin Group, be advised of Council 's decision. ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Map 2.0 BACKGROUND 2 . 1 The subdivision agreement between the Town and Aspen Springs states that the developer is responsible to close a portion of the road allowance known as Martin Road between Lots 14 and 15, Concession 1, former Bowmanville. The intersection at Martin Road and Regional Road 57 is considered hazardous . It was therefore imposed, as a condition of approval, that Martin Road be closed to vehicular traffic and traffic be routed to Regional Road 57 via Baseline Road. The intersection of Baseline Road and Regional Road 57 is signalized. 2 .2 The road closure consists of the land between Candler Court and Prestonway Drive (see Attachment No. 1) . It is anticipated that, in the future, a sidewalk will be required between Candler Court and Prestonway Drive. Therefore, the road allowance will be closed to vehicular traffic only and will remain in the Town's ownership. 3.0 CIRCULATION 3 . 1 The road closing application was circulated to all departments, agencies and authorities . No objections were received with respect to the road closing. 4.0 COMPENSATION 4 . 1 The applicant/developer is responsible for all costs associated with the road closure. The developer is responsible to remove existing pavement, provide screening for traffic safety, and landscape the subject area. . . . /3 i REPORT NO. : WD-72-92 PAGE 3 5.0 RECOMMENDATION 5 . 1 That a portion of the road allowance known as Martin Road between Lots 14 and 15, Concession 1, Bowmanville, be closed to vehicular traffic in accordance with Town Policy, provided the applicant satisfies all conditions of the Public Works Department.
