THAT Report WD-74-92 be received; 2 . THAT, in accordance with Council 's direction, removal of snow and ice from sidewalks and driveway windrows be provided for senior citizens and the physically disabled and for the Bowmanville, Newcastle and Orono Business Improvement Areas as outlined in Report WD-74-92; 3 . THAT funds for the estimated cost of $15,650 for providing the service in 1992 be obtained from Account No. 7212-92004-0261, Senior Snow Clearing, in the approved 1992 Capital Budget; and 4 . THAT funds be provided in the 1993 Budget for the program. ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: By-law 87-197, Removal of snow and ice within the Town of Newcastle No. 2 : Proposed Application for Sidewalk and Driveway Windrow Snow Clearing for Senior Citizens and the Physically Disabled No. 3: Proposed Advertisement No. 4 : Proposed letter /2 ii REPORT NO. : WD-74-92 PAGE 2 No. 5: Plans showing the extent of the Business Improvement Areas in Bowmanville, Newcastle and Orono No. 6 : Plans showing the extent of the urban areas of Courtice, Bowmanville, Newcastle and Orono No. 7: Report WD-4-92 2.0 BACKGROUND 2 . 1 At a meeting held on November 26, 1990, Council passed Resolution #C-766-90: "THAT the correspondence dated November 5, 1990, from Roxann Brown, Chairman, Newcastle Community Care, pertaining to the implementation of a sidewalk and driveway snow clearing program for senior citizens and the physically disabled in the Town of Newcastle, be received; THAT the correspondence be referred to the Director of Public Works for the preparation of a report; and THAT Roxann Brown be advised of Council's decision. " 2 .2 At a meeting held on February 28 i 1992, Council approved Resolution #GPA-187-92 : "THAT $32,000 be included in the 1992 budget for a snow clearing program to be in place for the winter of 1992 - 1993; and THAT staff report back to Committee on implementation of the snow clearing program for: a) Senior Citizen's property; and b) Business Improvement Areas. " . . . /3 i REPORT NO. : WD-74-92 PAGE 3 3.0 REVIEW AND COMMENT 3 . 1 By-law By-law 87-197 requires that: "every owner or occupant of every building, lot, or parcel of land fronting or abutting on any street or highway shall clear away and remove, or cause to be cleared away and removed, the snow and ice entirely from the sidewalk on the highway in front of, alongside of or at the rear of such building, lot or parcel of land, within twenty-four (24) hours from the commencement of snowfall. " 3 .2 Rural and Urban Service It is recommended that the removal of snow and ice from sidewalks and driveway windrows be provided only for the urban areas of Courtice, Bowmanville, Newcastle and Orono, as shown on Attachment No. 6 . The reasons for this recommendation are as follows: 1. Provision of this service in the rural areas will be very costly; and 2 . The City of Oshawa does not provide this service in the rural areas . 3 .3 Level of Service It is recommended that the level of service be the same as required in the Town of Newcastle By-law 87-197; namely, that the snow clearing be completed within twenty-four (24) hours from the commencement of snowfall. I 3 .4 Eligibility Requirements It is recommended that, to be eligible for the program, applicants must be sixty-five (65) years of age or older or be physically disabled, occupy a single family dwelling which fronts onto a Town street and have no able bodied persons . . . /4 REPORT NO. : WD-74-92 PAGE 4 under the age of sixty-five (65) years residing on the property. This would include semi's, row housing and townhouses. 3 .5 Advertising It is recommended that the program be advertised by inserting the proposed advertisement (Attachment No. 3) in the local newspapers . 3. 6 Bowmanville, Newcastle and Orono Business Improvement Areas In accordance with Council direction, it is proposed that the removal of snow and ice from sidewalks and driveway windrows be provided for the Bowmanville, Newcastle and Orono Business Improvement Areas . The extent of these areas is outlined in Attachment No. 5 . The sidewalk snow clearing and sand/salting for the Business Improvement Areas is subject to the following conditions : 1. Service will be initiated only when the call-out is made by the Public Works Department; and 2 . Service shall only commence during the night time or early morning hours . 3 . 7 Administration It is proposed that the administration of this program, including processing of applications, be done by Town staff who would be supplemented by temporary employees as required. 3 .8 Estimated Costs for the Senior Citizens and Physically Disabled In Report WD-4-92 (Attachment No. 7) , dated January 6, 1992, Council was given an estimate of $32,000 per year to provide . . . /5 I i I REPORT NO. : WD-74-92 PAGE 5 snow and ice removal service for senior citizens for 600 sidewalk locations and 700 driveway windrow locations . Revised estimates, which are considerably higher than the January estimates, based on new information obtained from the City of Oshawa are as follows: 1992 1993 Sidewalks and Windrows $ 5,0001 $20,0002 Administration 7 ,000 27 ,000 $12,000 $47,000 Notes : 1. Estimate based on $5 per location for 250 locations for four (4) snow storms . 2 . Estimate based on $5 per location for 250 locations for sixteen ( 16) snow storms . 3 . This cost estimate includes advertising, processing applications, site inspections and other administration. 3 . 9 Estimated costs for the Business Improvement Areas The estimated costs for providing snow and ice removal and windrow removal service in the Bowmanville, Newcastle and Orono Business Improvement Areas are as follows : 1992 1993 Sidewalks and Windrows $ 2,4001 $ 9,6002 Extra Patro13 1,250 5,000 $ 3,650 $14,600 Notes : 1. Estimate based on $600 for all three (3) Business Improvement Areas for four (4) storms. 2 . Extra patrols required on weekends because the snow on the sidewalks must be removed not later than 8:00 a.m. on Saturday. 3 . 10 Summary of Costs 1992 1993 Sidewalks and Windrows $12,000 $47,000 for Seniors and the Disabled Sidewalks and Windrows 3,650 14,600 in the Business Improvement Areas $15,650 $61, 600 3 . 11 Impact on Budget The amount provided in the 1992 approved budget for "Winter Control" is $862,050 . This amount is subsidized at a rate of 50% by the Ministry of Transportation; the balance, $431,025, is obtained from the general tax levy. As noted above in Clause 3 . 10, the estimated costs in 1993 for providing removal of snow and ice from sidewalks and windrows for senior citizens and the disabled and for the three (3) Business Improvement Areas is $61,600, all of which must come from the general tax levy. AND WHEREAS Section 210 (54) of The Municipal Act, R.S.O., 1980, provides that Councils of municipalities may pass by-laws to provide: for clearing away and removing snow and ice from the Removal of Snow roofs of any designated class of unoccupied buildings and Ice from in the municipality or any designated area thereof and Roofs and Side- for clearing away and removing snow and ice from the walks of sidewalks on the highways in front of, alongside or at Unoccupied the rear of any designated class of unoccupied buildings ' Premises or vacant lands at the expense of the owners and for collecting or recovering the expenses incurred in so doing in the manner provided by Section 325. AND WHEREAS Section 210 (55) of The Municipal Act, R.S.O., 1980, provides that Councils of municipalities may pass by-laws to provide: for clearing away and removing snow and ice from the sidewalks Removal of on any highway or part of a highway or any class thereof in Snow and Ice front of, alongside or at the rear of any occupied or From Sidewalks unoccupied building or vacant lot, or any class thereof, at the expense of the owners, and for collecting or recovering the expenses incurred in so doing in any manner including the manner provided by Section 325. AND WHEREAS Section 325 of The Municipal Act, R.S.O., 1980, provides that Councils of municipalities may pass by-laws to recover the expense incurred by action, or the amount may be entered in the tax collector's roll and recovered In a like manner as municipal taxes. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. In the geographic area of the Town of Newcastle, every owner or occupant of every building, lot, or parcel of land fronting or abutting on any street or highway shall clear away and remove, or cause to be cleared away and removed, the snow and ice entirely from the sidewalk on the highway in front of, alongside of or at the rear of such building, lot or parcel of land, within 24 hours from the commencement of snowfall. 2. In the geographic area of the Town of Newcastle, every owner or occupant of every building upon a lot fronting or abutting on a sidewalk on a highway, where the closest point of the eave of such building is less than three metres measured horizontally from the sidewalk, shall clear away and remove, or cause to be cleared away and removed, the snow and ice from the roof of such building within 24 hours from the commencement of snowfall. ATTACHMENT N0. 1 WD-74-92 - 2 - 3. The snow and ice required to be removed under paragraphs 1 and 2 hereof, shall be removed without damage to the sidewalk, with proper care and precaution for the safety of persons passing and shall be deposited in such a way as not to obstruct access to any fire hydrant. 4. No person shall place any snow or ice from his or her property upon the travelled portion of any highway or upon any sidewalk in the Town of Newcastle. 5. Where an owner or occupant has failed to comply with the requirements of paragraphs 1 and 2 hereof, The Corporation of the Town of Newcastle, upon 2 hours prior notice in writing to the owner or occupant of such lot or parcel of land, or building, may clear and remove such snow or ice as is , required to be removed under paragraphs 2 and 3 hereof and for that purpose its servant or agents may enter upon any lot or parcel of land and any building to remove snow or ice from the roof thereof. 6. Notwithstanding paragraph 5 hereof, where the Corporation of the Town of Newcastle is unable to immediately locate the owner or occupant of the lot or building, no notice need be given and the Corporation of the Town of Newcastle may clear and remove such snow and ice as is required to be removed under paragraphs 2 and 3 hereof, and for that purpose its servants or agents may enter upon any lot or parcel of land and any building to remove snow and ice from the roof thereof. 7. In the event of an emergency, real or apprehended, the Corporation of the Town of Newcastle may clear and remove such snow and ice as is required to be removed under paragraphs i and 2 hereof, and for that purpose its servants or agents may enter upon any lot or parcel of land or any building without prior notice to the owner or occupant. 8. In the event that snow and ice is removed from the sidewalks on the highway in front of, alongside of, or at the rear of such lot or parcel of land, or from the roof of any building by The Corporation of the Town of Newcastle, its servants or agents, the expenses incurred in such cases may be recovered by action, or the amount may be entered in the tax collector's roll and recovered in the like manner as municipal taxes. 9. The Corporation of the Town of Newcastle may clear away or remove snow and ice from the roofs of all unoccupied buildings where the eave of such building is less than three metres measured horizontally from the sidewalk, without notice to the owner thereof, and the expenses incurred in so doing may be recovered by action, or the amount may be entered in the tax collector's roll and recovered in like manner as municipal taxes. 10. The removal of snow or ice by The Corporation of the Town of Newcastle, its servants, agents or employees, shall not relieve any person from liability for breach of the provisions of this by-law. it. Any person who violates the provisions of this by-law shall be guilty of an offence liable on conviction thereof to a penalty of not less than $50.00 and not more than $200.00, exclusive of costs for each such offence, and every such penalty shall be recoverable under the provisions of The Summary Convictions Act. 12, 8y-law 78-119 of The Corporation of the Town of Newcastle is hereby repealed. - 3 - 13. This by-law shall come into force and take effect upon the day of enactment. This includes semi-detached, link housing and row housing. To be eligible for this service, applicants must be 65 years of age or older or be physically disabled, occupy a single family dwelling which fronts on to a Town street, and have no able bodied persons under the age of 65 years residing on the property. Application Forms can be obtained by calling 623-3379 or they can be picked up at the Municipal Administrative Centre at 40 Temperance Street, Bowmanville, Ontario. Director of Public Works i i ATTACHMENT N0. 3 WD-74-92 THE TOWN OF e na s I 6e ONTARIO 1992 Dear Resident: RE: Sidewalk and Driveway Windrow Snow Clearing Program This letter is an outline of the Sidewalk and Driveway Windrow Snow Clearing Program which the Town of Newcastle is initiating for the 1992-93 winter season. We ask that you keep this letter available for future reference. Sidewalks The Town's snow clearing service is on Town sidewalks only for the urban areas of Courtice, Bowmanville, Newcastle and Orono. The service will start the day after a snowfall ends and only when there is approximately one (1 ) inch or more of snow on the sidewalks. All sidewalk clearing is to be completed within the next 24 hour period. Driveway Windrows The driveway windrow is the accumulation of snow left at the end of your driveway by the Town snowplows. The driveway windrow snow clearing service WILL NOT be undertaken until all sidewalks are cleared and the plowing on the streets in your area has been completed. Snow removal includes the windrow at the end of the driveway only. All driveway windrows will be removed: only once per storm; and by the end of the second day after the snowfall. General Information Based on snow conditions, the Town may only require sidewalks to be cleared. The Town cannot guarantee schedules for snow removal other than sometime within the time periods noted above. Please be patient as there will be numerous participants in this program. " 3.0 REVIEW AND COMMENT 3. 1 The City of Oshawa has a program of providing service to the elderly and/or disabled to clear the snow from sidewalks and/or windrows. 3.2 The City requires the applicant to complete an application form (Attachment No. 2 ) . The basic requirements to obtain the service are: To be eligible for the service, applicants must be 65 years of age or older or be physically disabled, . occupy a single family dwelling which fronts onto a city street and have no able bodied person under the age of 65 years residing on the property. " 3.3 Attachment No. 3-is a copy of a letter which was sent out to the eligible residents in 1991 to explain the program. If the Town decided to provide the service, it would seem reasonable to provide the service on a similar basis as that used by the City of Oshawa. 3 .4 During the 1990-91 winter, the City of Oshawa provided the following service: (a) Plowing of Sidewalks: 1,600 properties Cost: Administration $ 9, 000.00 Plowing 43 , 000.00 TOTAL COST $ 52 ,000.00 Cost per property per year = $ 32 .50 . . . /3 0'3 i REPORT NO. : WD-4-92 PAGE 3 (b) Plowing of Driveway Windrows: 1, 840 properties Cost: Administration $ 5, 600.00 Plowing 26,500. 00 TOTAL COST $ 32 , 100 . 00 Cost per property per year $ 17 .45 3 .5 Based on the City of Oshawa experience, the Town could expect to have about 600 eligible applicants -for the plowing of sidewalks and 700 eligible applicants for the plowing of driveway windrows. 3 .6 Based on the City of Oshawa per unit costs, the annual cost would be about $32, 000. 3 . 7 It should be noted that a program of this type would require a high amount of administration. For this reason, the City of Oshawa has entered into a contract with the Minacs Group Inc. to administer the program for the City. At our last Committee meeting, we discussed the attached notice published recently in The Oshawa Times. Our committee would like Council to give serious consideration to. the feasibility of implementing such a program for senior citizens and the physically disabled in the Town of Newcastle. Community Care would be most interested in learning what' the 'costs for such a program would be to the municipal taxpayers. It is our request that this item be placed on Council's. Agenda for discussion at the earliest opportunity. To be eligible for this service, applicants must be 65 years of age or older or be "r physically disabled, occupy a single family dwelling which fronts on to a City street, and have no able bodied persons underthe age of 65 years residing on the property. In order to be adequately prepared for next winter's program, Renewal of .Application forms have been mailed out to the participants of last year's program. They are encouraged to complete and return this Renewal. Those not currently registered for the program and who are now eligible should apply in person at 71 Albert Street, Oshawa, Ontario between 9:00 a.m. and 5:00 p.m., Monday to Friday. Staff will assist in completing the application form. All sidewalk clearing is to be completed within the next 24 hour period. !RIVEWAY WINDROWS THE DRIVEWAY WINDROW IS THE ACCUMULATION OF SNOW LEFT AT THE END OF YOUR •RIVEWAY BY THE CITY SNOW PLOWS - The driveway windrow snow clearing service will NOT be undertaken until all sidewalks are cleared and the plowing on the streets in your area has. been completed. Snow removal includes the windrow at the end of the driveway only. All driveway windrows will be removed only once per storm. All driveway windrows will be removed by the end of the second day after the snowfall. ::ENERAL INFORMATION Based on snow conditions the City may only require sidewalks to be cleared. The City cannot guarantee schedules for snow removal other than sometime within the time periods noted above. Please be patient as there are over 2,000 people registered with this program.
