Subject: CENTRAL ONTARIO FOUR WHEEL DRIVE CLUB - REQUEST FOR PERMISSION
TO REPAIR FISH DAMS, BRIDGES, AND CLEAR TRAILS AND BACKROADS
ON HIGHWAY 57 IN THE VICINITY OF BURKETON
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-83-92 be received;
2 . THAT the request of the Central Ontario Four Wheel Drive Club
for permission to repair fish dams, bridges, and clear trails
and backroads be denied;
3 . THAT Robert Maddocks be advised of Council 's decision; and
4 . THAT the Township of Scugog and the Township of Manvers be
provided with a copy of Report WD-83-92 and be advised of
Council's decision.

2 . 1 Mr. Robert Maddocks, representative of the Central Ontario
Four Wheel Drive Club, made a presentation to Council on July

13, 1992, requesting permission for his club to repair fish
dams, bridges, and clean trails and backroads in the vicinity
of Region Road 57 and Burketon.
2 .2 On July 13, 1992, Council passed Resolution #C-507-92 as
follows:
"THAT the delegation of Robert Maddocks be
acknowledged and referred to staff for review
and the preparation of a report to be
submitted to the General Purpose and
Administration Committee; and
THAT Robert Maddocks be advised of Council 's
decision. "
3.0 DETAILS

3 . 1 Staff met with Robert Maddocks and Lorna McQueston to confirm
specific locations of their proposal and to determine the
nature and timing of the Club's events .
3 .2 Events
A number of events are planned annually throughout Ontario and
the United States . The types of events vary from one day
trail rides to weekend events . Participation is limited to
Club members .
The Club has approximately twenty (20) events annually. Mr.
Maddocks estimated that about four (4) events per year would
be planned for this area, consisting of 12 to 15 vehicles per
event.
Mr. Maddocks explained that the Club promotes environmental
awareness and responsible four-wheeling. Members of the Club
are willing to assist the Town, at the Town's convenience, to
clean up debris, repair small structures, etcetera, on
unopened road allowances in turn for permission to use various

trails and unopened road allowances for their events.
Mr. Maddocks emphasized the Club's "code of behaviour" and
their commitment to not trespass where abutting owners oppose
their presence.
3 . 3 Proposed Road Allowances to be Used
Boundary Road: road allowance between Township of Scugog
and former Darlington Township; and
Boundary Road: road allowance between Township of Manvers
and former Darlington Township.
The proposed roads are boundary roads and are unopened. A
meeting was held with Mike Donnelly (Township of Scugog) and
Don Earle (Road Superintendent of the Township of Manvers) to
discuss the request.
3 .4 Problems Identified if the Request is Approved
a. The proposed road allowances are boundary roads;
therefore, three municipalities are involved in the
approval process . Manvers and Scugog representatives are
recommending that the request be denied.
b. Currently the natural obstructions on unopened road
allowances discourage traffic. Clearing obstructions and
brush would increase usage. We are currently fencing
some unopened road allowances due to illegal dumping and
damage caused by all-terrain vehicles especially where
farms depend on the road for access to fields .
C . Assistance with clearing and cleaning up debris poses
the following problems :

i. Safety training is provided to our employees and
strict safety measures are enforced. A volunteer

group is not within our jurisdiction; therefore, we
have no authority to enforce the regulations;
ii. We do not have the manpower to work on unmaintained
roads . Wages and equipment expenses are
subsidizable when performing maintenance on open
roads;
iii. Tipping fees for debris being hauled to the landfill
site would be the Town's expense. Money has not
been budgeted for extra tipping fees;
iv. Affiliated employees may oppose the volunteers
performing work they are hired to do;
V. Seasonally, there may be conflict with other
vehicles, e.g. snowmobiles and four wheelers; and
vi. Residents living in the area may be opposed.
4.0 SUMMARY
4 . 1 Ultimately, if the municipality grants permission to use
unopened road allowances for recreational purposes, the
municipality may be held liable for incidents occurring on the
unopened road allowances.
