'CERTIFICATE OF ACCEPTANCE'
TUNNEL WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-86-92 be received; and
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the tunnel works, constructed
within Plan 1OR-3566 .

2.0 BACKGROUND
2 . 1 The Town of Newcastle entered into an agreement, registered
January 9, 1991, with Carholme Investments Limited, Esquire
Developments Limited and Oceanfront Developments Limited.

The agreement required the developer to construct tunnel works
adjacent to and under the Canadian National Railway (CNR)
lands, described as Parts. 1 and 2 on Plan 1OR-3566,
hereinafter referred to as the 'Works ' .
2 .2 The Works were completed through pre-servicing prior to the
registration of the Agreement. A 'Certificate of Completion'
was issued dated August 31, 1990 and the Works were placed on
a two year maintenance period which expired on August 31,
1992 . These Works were subsequently re-inspected and were
found to be satisfactory.
2 . 3 A separate Pipe Crossing Agreement between the Town of
Newcastle and CNR, executed August 31, 1989, authorized
construction of the Works within CNR lands . A subsequent
letter from CNR, dated September 24, 1990, states their
satisfaction with the installation and completion of the Works
through their lands . (Attachment No. 2)
2 .4 It is now appropriate to issue a 'Certificate of Acceptance'
for the Works . The agreement provides for this certificate
to be issued by the Director of Public Works, subject to the
approval of Council .
