HomeMy WebLinkAboutWD-89-92 THE CORPORATION OF THE TOWN OF NEWCASTLE REPORT Meeting: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE File , Date: December 7, 1992 Res. # -0 Report#: File #: 13 . 002 By-Law# Subject: WAVERLY HEIGHTS SUBDIVISION, PLAN 1OM-813, BOWMANVILLE 'CERTIFICATE OF ACCEPTANCE, AND 'ASSUMPTION BY-LAW' , ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS AND OTHER RELATED WORKS Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-89-92 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system, street lights and other related Works, constructed within Plan 10M-813; and 3 . THAT Council approve the by-law attached to Report WD-89-92 assuming the streets within Plan 10M-813, as public highways . ---------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2 : Road Dedication By-law 2.0 BACKGROUND 2 . 1 On August 17, 1988, the Town entered into a subdivision agreement with Waverly Heights Subdivision (Oshawa) Ltd. to develop lands by plan of subdivision, located in Bowmanville and described as Plan 1OM-813 (Attachment No. 1) . /2 REPORT WD-89-92 PAGE 2 The agreement required. the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works ' . 2 .2 The Works were completed and a 'Certificate of Completion' was issued dated July 15, 1990 . The Works were placed on a two year maintenance period which expired July 15, 1992 . 2 . 3 All of the Works were subsequently re-inspected and were found to be satisfactory. 2 .4 It is now appropriate to issue a 'Certificate of Acceptance' for all of the Works described. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2 .5 Further to the issuance, of a "Certificate of Acceptance' , a by-law is required to permit the Town to assume all the streets within Plan 1OM-813 as public highways . DRAWN BY; JM 0:03 92 ATTACHMENT NO. 1 KEY MAP WD-89-92 « 03 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92- Being a By-Law to assume certain streets within the Town of Newcastle as public highways in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets and street widening Block 41, as set out in Registered Plan 1OM-813 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use.
