THAT Report CLD-O 17 -01 be received; 2. THAT the by-law attached to Report CLD-017-01, being a by-law to amend the Procedural By-law 95-55, be forwarded to Council for approval; and 3. THAT all interested parties and any delegations be advised of Council's decision. .Reviewed bQ ~ ~~ Franklin Wu, Chief Administrative Officer PLB*hk 816 . ,-- REPORT NO.: CLD-017-01 PAGE 2 BACKGROUND AND COMMENT The Council has requested the Clerk's Department to review the Municipality's procedural by-law as it relates to hearing delegations at Committee and Council Meetings. The procedural by-law states that individuals wishing to appear as a delegate must register with the Clerk no later than Wednesday noon prior to the Monday meeting. Delegations are limited to ten minutes except that a delegation consisting of more than ten persons shall be limited to two speakers, each limited to speaking for ten minutes. There has been concern recently that some individuals have been unaware of an issue being considered by Committee/Council until after the deadline to register as a delegation. In this case, the only method available in order to add the individual as a delegation is to suspend the Rules of Procedure. In order to pass, this resolution requires a vote of 0/. of the members present. In order to alleviate this concern, it is recommended that the procedural by-law be amended to allow for individuals to be added as delegations at the commencement of the meeting based on the following criteria: . The delegation will be added only in the instance where the meeting is the final approval stage of an issue, ie., at the Council meeting or when a recommendation is being made to the General Purpose and Administration Committee, FORTHWITH. If the recommendation to Committee is not made FORTHWITH, individuals still have an opportunity to have their delegation registered for the Council meeting when the recommendation is being approved. . The delegate must register with the Clerk's Department by 3:00 p.m., Friday prior to the Monday meeting. The agenda pages are posted on the municipality's web site by noon Friday. The 3:00 p.m. timeframe allows residents time to view the site and allows staff time to prepare for the Monday meeting. A memorandum will be circulated to advise of those individuals who have registered delegations. . The delegation be limited to five minutes, rather than the ten minutes allocated for delegations registered by noon Wednesday. 817 y , ~ -. PAGE 3 REPORT NO.: CLO-017-01 The by-law that is attached for Council's consideration also includes a provision to delete Section 21.5 of the by-law. This section states that the General Purpose and Administration Committee minutes are to be included in the Council Agenda. This practice changed some time ago, however, the by-law was never amended to reflect it. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2001- Being a by-law to amend By-law 95-55, a by-law to govern the proceedings of the Council of the Municipality of Clarington, any of its Committees, the conduct of its Members, and the calling of meetings WHEREAS at their meeting held on November 12, 2001, Council adopted the recommendations contained in Report CLD-017 -01; THEREFORE be it resolved that By-law 95-55, being a by-law to govern the proceedings of the Council of the Municipality of Clarington, any of its Committees, the conduct of its Members, and the calling of meetings be amended as follows: 1, THAT Section 17.4 be amended by adding the following thereto: If an individual has missed the Wednesday, noon deadline to register a delegation, the delegation will be added to the agenda at the commencement of the meeting based on the following criteria: (a) Only in the instance where the meeting is the final approval stage for the recommendation, ie., at the Council meeting or when the recommendation is made to the General Purpose and Administration Committee, FORTHWITH. (b) The delegate has registered with the Clerk's Department by 3:00 p.m. the Friday prior to the meeting. (c) The delegate will be limited to speaking not more than five minutes. 2. THAT Section 21. 5 be deleted. By-law read a first and second time this 1 ih day of November, 2001. By-law read a third time and finally passed this 12th day of November 2001.
