VICIOUS DOG DECLARATION. MICHALSKA

It is respectfully recommended:
1. THAT Report CD-31-0rge received; and
2. THAT the vicious dog declaration served on Stanislawa Michalska be upheld.
BACKGROUND AND COMMENT
On April 23, 2001, the Animal Services Division received a call from a man whose son had been bitten by
a dog in front of 72 Poolton Crescent in Courtice. This incident occurred on April 22, 2001, while the dog
(a daschund) was being walked, on a leash, by two children, The boy was standing outside the house
when the dog charged up to him, biting him in the leg and tearing his pants.
After speaking to the parties involved, the Animal Services Officer issued a declaration of vicious dog to
Mr. Michaiska. The declaration requires the owner of the vicious dog to:
1. licence and register the dog with the Clarington Animal Shelter and have the dog permanently
identified by microchip implantation, at his expense, within 21 days of receipt of the Declaration.
Proof of such registration must be provided to the Animal Services Division within 30 days;
2. notify the Clarington Animal Sheiter immediateiy upon relocating the dog or upon transferring
ownership of the dog;
3, restrain the dog at all times, while the dog is on his property, by keeping her enclosed in a pen or
other enclosure in such a manner as to prevent the dog from leaving the property and to prevent
contact with people and other animals;
4. restrain the dog at all times, while the dog is off his property, with the use of a muzzle and a ieash no
longer than 6 feet and under the care and control of a person who is 16 years of age or older.

Mr. Michalska will be addressing Council to appeal the vicious dog declaration on May 29, 2001. It is
staffs recommendation that the vicious dog declaration be upheld.
