THAT Report CD-40-01 be received; 2. THAT, because of financial implications, the six-month Vicious Dog Declarations issued on Mr. Trotman, Mr. Baylis and Mr. Stacey be amended by deleting the following requirements: . Microchipping of the dogs . Enclosing the animals in pens or other enclosures while the dogs are on their own properties; and 3. THAT Mr. Trotman, Mr. Baylis and Mr. Stacey be advised of Council's decision. BACKGROUND AND COMMENT: On June 11, 2001, Council considered appeals to three Vicious Dog Declarations, namely, Trotman, Stacey and Baylis. During the delegations of Mr. Trotman and Mr. Baylis, some questions arose as to the depth of the investigation undertaken prior to the declarations being issued. The procedures being followed by staff during investigations are presently being reviewed and improved upon. Both Mr. Trotman and Mr. Baylis submitted letters attesting to the good nature of their dogs (copies attached hereto). Following the delegations, Council passed resolutions to put the Vicious Dog Declarations in place for a six month period. Part of the declarations require the dog owners to microchip their dogs and enclose the animals in a pen or other enclosure while the dogs are on their own properties. Because of the financial . Report CD-40-01 - 2 - June 25, 2001 implications of each of these requirements and given the fact that Council has put the declarations in place for only a six month period, it is recommended that the declaration be amended by deleting these requirements. The other requirements of the declaration are as follows: . Licence and register the dog with the Animal Shelter . Notify Animal Services upon relocating the dog or transferring ownership . Restrain the dogs while off their property with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older It is recommended that these requirements remain in effect. Prior to considering this report, it will be necessary for a motion to suspend the rules of procedure to allow for reconsideration of the earlier actions to be introduced. To Whom It May Concern: This letter is to certify that the Akitas, "Brutus & Sonya", owned by Mr. & Mrs. Trotman, have sucessfully completed a five week COMPANION DOG program at Havelberg Dog Academy. This rigorous obedience program, implemented and professionally developed since 1968 by Canadian Record Holder Wolfram H. Klose, teaches the dogs to behave in an acceptable man- ner. The owner then attains the skills and knowledge to properly manage their pets to the best of its ability. Exercises such as "SIT", "DOWN", and "STAY" are a means of communicating with the animal and allowing the owner to attain a dominate, or "Alpha" position in the animals natural pack hierarchy. Dogs are driven by instinct, though bound and confined by urbanization. Obedience is a means to control these mannerisms by encouraging desired behavior and oppos- ing the undesirable, thus molding an ideal citizen. ~ Mr. & Mrs. Trotman have taken the time, effort and cost to be assured that their companions, "Brutus & Sonya", are well behaved pets. Re: Declaration of Vicious Dog #01-09 Dear Mayor and Members of Council, I am here tonight to dispute the above declaration of Vicious Dog. I must first of all state that I respect the system that this municipality has in place however, this particular document disturbs me greatly and I would therefore like to make the following points. 1. The document states that an investigation was carried out. There were four children present, the oldest being fifteen years of age, who to my knowledge were not included in the investigation process, and I have not been notified that there were any other witnesses to the event. 2. Prior to the issue of this declaration, my wife or myself have not had any communication with Animal Services Division with respect to my dog being declared vicious, 3. My wife and myself who left on our bicycles just prior to this incident, noticed that Mrs.Sprague was walking towards our property on the road accompanied by her dog that was not on a leash. 4. My fifteen year old son and three other children who were playing in the driveway, stated that when the dogs started to fight Mrs. Sprague tried to put the leash on her dog and confusion followed. 5. In the four years that we have owned this dog, we have never had any complaints. If I were convinced in my own mind of any evidence that my dog were vicious, I would go further than the requirements of this declaration and have our dog peIDlanently removed from our property. However, in the interest of my son who owns the dog, I would have to convince him that the evidence is substantial in proving that his dog is in any way vicious, I further enclose a signed petition of close neighbours bearing witness that they have never experienced our dog being anything but friendly to them and their pets, a letter from the owner of the property opposite and in particular a letter from Dr,Mingram of Clarington Animal Hospital. I therefore respectively request that this order be rescinded or at the very least this Council order further investigation. I would be happy to take part in any further enquiry to resolve this issue in a manner that is acceptable to yourself, the Animal Services Division, the community and myself. She has had all her annual exams and vaccinations. She is a pleasure to deal with at the veteritwy hospital and has never been aggressive to me, my ~1aff or other HnimHI~ in the waiting ruom. I am unsure how she was provoked To me, she has always been a wonderfully nice pet to deal with.
