SA YLlS By-law # Report #: Recommendations: It is respectfully recommended: 1. THAT Report CD-36-01 be received; and 2. THAT the vicious dog declaration served on Alan Baylis be upheld. BACKGROUND AND COMMENT On May 10, 2001, a woman was walking her dog, Smokey, down Rundle Road. As she approached the Baylis' home, she put Smokey on her left knowing if the Baylis' dog Dusty was around he may attack her dog. As she approached, she noticed children in the yard playing with Dusty. Once he saw her dog he came to the road and attacked Smokey. She screamed to the children to call their dog -- who at this point was fighting Smokey on the road. After calling a couple of times, Dusty went back to them however, the woman had been bitten and was very angry that Dusty had attacked her dog. She indicates that this is not the first time that she has been bitten by Dusty, however, she did not report the two previous incidents. She is concerned that she cannot walk down the street without this dog attacking her or her dog. Following this incident, the Police Department was contacted. They attended and spoke to the Baylises who were very cooperative and stated that no one had complained previously. They were instructed by the Police Department to keep their dog tied up. The Police Department report indicates that this seems to be a public safety concern, particularly if a younger child were walking a dog past the property. The Animal Services' Officers, upon receiving the Police Report, issued a Vicious Dog Declaration on Alan Baylis. . . , . ,.. REPORT NO.: CD.36.01 PAGE 2 This declaration states that the owner of the vicious dog will: 1. licence and register the dog with the Ciarington Animal Shelter and have the dog permanently identified by microchip implantation, at his expense, within 21 days of receipt of the Declaration. Proof of such registration must be provided to the Animal Services Division within 30 days; 2. notify the Clarington Animal Shelter immediately upon relocating the dog or upon transferring ownership of the dog; 3. restrain the dog at all times, while the dog is on his property, by keeping it enclosed in a pen or other enclosure in such a manner as to prevent the dog from leaving the property and to prevent contact with people and other animals; 4. restrain the dog at all times, while the dog is off his property, with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older. Mr. Baylis has indicated his desire to address Council regarding this matter on June 11, 2001. It is staff's recommendation that the vicious dog declaration be upheid.
