STACEY Res. # Report #: By-law # Recommendations: It is respectfully recommended: 1. THAT Report CD-35-01 be received; and 2. THAT the vicious dog declaration served on Paul Stacey be upheld. BACKGROUND AND COMMENT On Saturday, April 21, 2001, a woman residing on Brown Street, Bowmanville, heard a strange yelping outside, opened her back door and found her 10 year old Sheltie, Solly, on her back with a large dark dog standing over her biting at her chest. Solly is approximately knee high and weighs about 25 Ibs. When the woman yelled and clapped her hands, the large dog, which she has identified as a German Shepherd, left. Solly was brought into the house and later a large gash was found on her right hind flank. The dog was taken to the Newcastle Vet Clinic on Monday, April 23, 2001, where an eight inch wound on the right flank and a smaller wound on the left flank were sutured. The total of the vet bill was $198.49. Animal Services was called on that day, however there was not enough information regarding the attacking dog for further investigation. On Wednesday, April 25, 2001, at approximately 3:15 p.m., the same woman was walking her daughter home from school when she noticed a dark German Shepherd dog running erratically at the Queen Street and Brown Street intersection. She approached a man standing at the intersection, asked if it was his dog and explained the attack which had taken place the previous Saturday. The gentleman indicated that it was his son's dog and gave the woman his son's name and address. He indicated that the German Shepherd had broken out of the house and wouldn't come to him. They discussed the option of calling Animal Services as the lady recognized as the dog who attacked Solly. ~ REPORT NO.: CD-35-01 PAGE 2 Upon returning home, she immediately contacted Animal Services with the name and address of the dog's owner. At 3:35 p.m. the dog, still at large, entered the woman's backyard through the cedar hedge and crossed by her back door patio before leaving via the front yard. Her dog was not outside at this time. Upon receiving the information, the Animal Services' Officers issued a Declaration of Vicious Dog on Mr. Stacey. This declaration states that the owner of the vicious dog will: 1. licence and register the dog with the Clarington Animal Shelter and have the dog permanently identified by microchip implantation, at his expense, within 21 days of receipt of the Declaration. Proof of such registration must be provided to the Animal Services Division within 30 days; 2. notify the Clarington Animal Shelter immediately upon relocating the dog or upon transferring ownership of the dog; 3. restrain the dog at all times, while the dog is on his property, by keeping her enclosed in a pen or other enclosure in such a manner as to prevent the dog from leaving the property and to prevent contact with people and other animals; 4. restrain the dog at all times, while the dog is off his property, with the use of a muzzle and a leash no longer than 6 feet and under the care and control of a person who is 16 years of age or older. Mr. Stacey has indicated that he will be addressing Council on June 11,2001, to appeal this declaration. It is staff's recommendation that the vicious dog declaration be upheld.
