REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF NOVEMBER 15, 1982.
REPORT NO. WD-92-82.
SUBJECT: LDCM INVESTMENTS LIMITED & BARMOND BUILDERS
LIMITED.
BLOCK 'C' , REGISTERED PLAN 698, BOWMANVILLE.
RELEASE OF DEVELOPMENT AGREEMENT.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the Town Solicitor prepare the necessary
documentation for the execution and Final
Release of Block 'C' , Registered Plan No. 698,
from the Subdivision Agreement; and,
3. That the Mayor and Clerk be authorized to issue
a Certificate of Release on behalf of the Town
of Newcastle.
BACKGROUND:
In September, 1972, the Corporation of the Town of Bowmanville
entered into an Agreement with LDCM Investments Limited and Barmond
Builders Limited for the development of Registered Plan No. 698.
In May of 1976 the Town of Newcast(e entered into a Site Plan

Agreement with the Owners, for the specific development of the
Townhouse units (Block 'C' ) , with the Works Installed to be in
accordance with the provisions of the Subdivision Agreement.
Further, in August of 1978, a partial release of the Subdivision
Agreement was registered, excluding Blocks 'B' and 'C' .
REPORT:
Mr. J. Madden, representing the Owners of the development, has
requested a Final Release of the Subdivision Agreement in respect
of the Townhouse units (Block 'C' ) . All works have been inspected
and are satisfactory to both the Regional Municipality of Durham
and the Town of Newcastle Public Works Department. All items of
the Agreement have been complied with, and it is recommended that
the Subdivision Agreement be released.

We enclose for your information a photo copy of 1OR-3067. As the plan showns our
clients building encroaches on Monroe Street and Mill Street as shown on this Plan.
We wish to enter into an encroachment agreement or obtain a tolerance letter from you
so as to allow for the sale of this property. It is our understanding that this is
an older building, although we do not know the exact age.
Could you please consider this matter and advie the writer of your process in
this -regard.
