SUBJECT: COUNCIL RESOLUTION C-154-82 (FEBRUARY 15, 1982) . CLOSURE AND CONVEYANCE OF THE ROAD ALLOWANCE BETWEEN LOTS 24 & 25, CONCESSION 4, FORMER TOWNSHIP OF CLARKE. RECOMMENDATION: It is respectfully recommended: 1 . That this report be received, and 2. That no further action be taken/c`in the matter of the closure and conveyance of the road allowance between Lots 24 & 25, Concession 4, former Township of Clarke. BACKGROUND: On September 16, 1981, Mr. W. Kay Lycett, on behalf Mr. Evans, wrote to the Town asking that Council formalize and legally convey the northerly 165 ft. of the subject road allowance, which had been closed by By-Law 1488 of the former Township of Clarke, but never conveyed, as had been the intention and understand at the time. Subsequently, in February of 1982, the matter was finalized and I the westerly 33 ft. of the road allowance, for a distance of 165 ft. south of the road allowance between Concessions 4 and 5 was offered to Mr. Lycett' s client, subject to the execution of a Deed by same. ' WD-_76-82 _ 2 _ In accordance with Resolution # C-154-82, Public Works Staff took the steps necessary to close and convey the balance of the road allowance to the abutting owners. This involved the preparation of a Reference Plan (No. 10-1481 ) and contacting the owners of seven parcels of land likely to benefit from acquisition of the abutting road allowance lands. Staff wrote to these owners on April 20, 1982, notifying them of Council 's intent, and advising of Town Policy and the requirements to be met. To this date we have had neither acknowledgement nor any indication of agreement or interest on the part of any of the owners and, therefore, can only assume that the possibility of acquiring additional lands is of no consequence the the area property owners. In accommodating the original request, and fulfilling the terms and direction of Resolution # C-154-82, fees for surveys have amounted to $1 ,101 . 00. It is felt that, due to the lack of interest on the part of the abutting property owners, little or no useful purpose would be served by obtaining an appraisal of land value, and no further funds should be expended on this item. Road Closure and Conveyance -(f-v,rns) The following re�iolutlon be r�lop�►��I; "WHEREAS it was not the practice in the former Township of Clarke to stop up and close an unopened road allowance unless it was to be conveyed; AND WHEREAS certain documents submitted in support of the subject application support this hypothesis; AND WHEREAS the practice has been confirmed by the former Reeve of the former Township of Clarke, Mr. J. W. Stone; BE IT RESOLVED that the Mayor and Clerk be authorized to execute a deed in favour of Mr. Donald C. Evans , conveying to him the northerly 165 feet of the westerly half of the unopened road allowance between Lots 24 and 25, Concesison 4 of the former Township of Clarke, now legally closed; BE IT FURTHER RESOLVED that the balance of the said closed road allowance be appraised and offered to the other abutting property owners in accordance with Town policy; and to facilitate the process, that a reference plan be acquired and the costs associated with the preparation of the reference plan be charged to the Reserve Fund - Sale of Road Allowances Account 5001 -003-006" subject to Mr. Stone' s signature being witnessed. An additional four copies of Plan 10 R 680 are also enclosed. The two plans represent ,,the entire subject road allowance comprising a total area of 10.634 acres (4.300 hectares). The parts designated on Plan 10 R 1481 represent the usual abutting interest of the adjacent property owners as well as recognizing the existence o substantial fencing. Further to your recent submission of the sketch No. 82028-CS, it would be appreciated if you would now complete the prep- aration of the reference plan in order that we may proceed with the closure and conveyance in accordance with Town Policy. As states in your letter of February 26, 1982, Plan IOR-680 covers the south one-half of the subject road allowance and depicts the easements held by the pipeline companies, there- fore there will be no necessity to duplicate same on the plan for which we are now asking; however, additional copies of Plan 1OR-680 would be of assistance to us in our negot- iations with the affected property owners. On February 15, 1982, Council , by Resolution # C-154-82, adopted a recommendation to close, and convey to the abutting property owners, the subject road allowance, in accordance with Town of Newcastle Policy, a copy of which is attached for your interest. Our preliminary research indicates that you are the owners of lands abutting the north half of the subject road allowance, as well as those lands on either side of the most southerly portion, across which there are existing pipeline easements. At this stage in the proposal to close and convey this road allowance, we are writing to all property owners whose lands abut same, asking that they indicate their interest and intent in respect of acquiring those lands to which they would be en- titled. Following the preparation of the Reference Plan, the Town will obtain an appraisal of land value and would be then in a position to advise you of the 'potential costs involved in any transaction. It would be appreciated if you would advise this office of your interest in this matter at your earliest possible convenience. At this stage we are writing to all property owners asking that they indicate, in writing, their interest and intent in acquiring the lands to which they are entitled under the terms of The Municipal Act. We are in the process of obtaining a Reference Plan and Appraisal of Land Value in respect of the road allowance and, upon the acquisition of same, will be able to define exactly your entitlement and the costs which would be involved. It would be appreciated if you would advise of your potential interest in this proposal at your earliest convenience; however, should you have any queries or concerns in this matter, please do not hesitate to contact this office. Our preliminary research indicates that you are the owner of lands on either side of the northerly section of the southern half of the subject road allowance and, as such, you would be offered the extent of the right-of-way which presently traverses same, to the limits of your holdings. At this stage we are writing to all property owners in the area asking that they indicate their interest and intent in acquiring the lands, as specified. We are also in the process of obtaining a Reference Plan and Appraisal of Land Value and, upon their receipt, will be in a position to accurately define the area and value of the lands to which you would be entitled under the terms and conditions of The Municipal Act.
