WD-74-82 SUBJECT: POLICY IN RESPECT OF SPECIAL EVENTS ON TOWN ROADS. RECOMMENDATION: It is respectfully recommended: 1. That this report be received, and; 2. That a by-law be passed requiring than any applicant, organization or agency wishing to hold a parade, sidewalk sale, or other special event, which will involve the use of a Municipal Road shall : (a) Hold an authorized Road Occupancy Permit. (b) File with the Town as co-insured, a Certificate of Liability Insurance for at least $1.0 million. (c) Secure the approval of Police, Fire, Ambulance and any other public service likely to be affected by the holding of the event, ensuring than any require- ments or conditions of those agencies is met. (d) Provide a written guarantee wherein the applicant(s) agrees to accept all costs involved in the Town's provisions of services, facilities, manpower and equipment for the accommodation of the event for which approval is sought. WD-74-82 - 2 _ IV BACKGROUND AND REPORT: Periodically, various organizations, charities, clubs, etc. , request Council approval for the holding of a special event, such as the annual Santa Claus Parade, the Sidewalk Sale, etc. , and it has been past practice to endorse such proposals and, at the same time, direct that any Town assistance needed insofar as the physical aspect of staging such events is concerned, be provided. It has become apparent, unfortunately, that the Town's co-operation in such affairs is becoming quite costly, and it is felt that a formal policy and procedure should be established in order that there should be no liability to the Town. To illustrate: Most special events of the type under discussion are held at a time when any services provided by the Town are outside of normal working hours, thereby incurring payment of overtime to the employees required to operate or install equip- ment. The rates the Town is required to pay for labour and mach- inery have risen significantly in the past few years, and although it is unfair to single out one particular event, the Santa Claus Parade seems to be a prime example. In November, 1980, the Public Works Department contribute manpower and equipment to the tune of $789; in 1981 these costs had risen to $860 and the projected 1982 expenditure is estimated at $1,000. While the Town and Staff is most supportive of this type of event, the reality of the impact on the public purse cannot be ignored. In addition to costs, there is concern related to the possibility of liability for damages to property or injury to individuals. By- Law 74-85 established the procedure of duly authorized Road Occupancy Permits which, while mainly aimed at protection for the Town against costs resulting from the actions of others (usually, and for the main part, agencies such as Bell Canada, Consumers' Gas, etc. ) the applicant is, quite often, required to file proof of Liability Insurance, naming the Town as co- insured; this coverage not only spans the period of time of the actual operation or occupancy, but gives protection against any occurrence which may arise as a result of same. WD-74-82 Similarly, in order to ensure co-operation and approval , the onus is on the applicant to notify the local Police, Fire and Ambulance services, plus any other agency or authority, which may be affected by the occupancy, for any reason, of a public road. It is felt that, in order to uniformly deal with all requests for approval of special events, the Town should receive formal assurance that all precautions have been taken to ensure the public safety, all costs should be borne by the applicant or agency making the request, and the Town should be insured against the prospect of any untoward incident which may arise. By making such formal application, Staff would be able to advise of estimated costs involved, schedule manpower and equipment to optimum advantage, and charge all costs against the specific event for which approval is sought, with 100% recovery of funds at a later date.
