SUBJECT: RESOLUTION # C-567-82 (JULY 5, 1982) NEWCASTLE VILLAGE, ORONO ESTATES, PROVISION OF GARBAGE COLLECTION SERVICES. RECOMMENDATION: It is respectfully recommended: 1 . That this report be received for information as input to possible requests for Municipally-sponsored garbage collection in areas where no such service presently exists. BACKGROUND: There have been recent enquiries of Members of Council and Staff concerning the possibility of providing Municipally-sponsored garbage collection in areas such as the Village of Newcastle and Orono Estates. On July 5, 1982, Council , by Resolution # C-567-82, directed Staff to investigate the feasibility of such a proposal and report on the matter, giving consideration to the timing of the present contract for garbage collection in the (former) Village of Orono. REPORT: s The Town, using it' s own forces, presently collects garbage in Bowmanville, and sponsors collection, on a contract basis, within the limits of the (former) Village of Orono. Other areas within WD-71-82 - 2 the Municipality, e.g. Newcastle Village, Orono, Hampton, etc. , have a private collection service, not administered by the Town. Any expansion of Town services to such areas would, most likely, be handled by a private collector under contract to the Town. In this respect, Section 210, ss. 83, 85 and 86, of The Municipal Act, would apply: Section 210, subsection 83, stipulates that a Municipality may pass by-laws for establishing and maintaining a garbage collection system, be it by contractor or otherwise; Section 210, subsection 85, stipulates that a Municipality may pass by-laws for collection and removal of garbage at the expense of the owners, and; Section 210, subsection 86, states that a Municipality may pass by- laws for charging the owners for garbage collection, be it through a monthly rate or through tax levy. There is no requirement for a petition for the above, nor is there any opportunity for a hearing in respect of anyone objecting to the garbage collection, or associated charges. Accordingly, the Town may, if it deems it advisable, arrange for Municipally- administered garbage collection in any area, and charge the benefitting owners through the tax bill . The present contract in respect of the Village of Orono garbage collection expires on December 31 , 1982; if Council wishes, the appropriate arrangements could be made to have any other urban areas included in the garbage collection contract when it is tendered later this year.
