RAIL CROSSING, LOTS 22 & 23, BROKEN FRONT CONCESSION, FORMER TOWNSHIP OF CLARKE (LOVEKIN). MILEAGE 155.66 BELLEVILLE SUBDIVISION. RECOMMENDATION: It is respectfully recommended: 1 . That this report be received, and; 2. That Council approve the expenditure of $6,906. 00 (Six Thousand Nine Hundred and Six Dollars) as the Town's share of the costs in respect of the install- ation of automatic protection at the C.P. Rail Crossing in Lots 22 & 23, Broken Front Concession, former Clarke, and; 3. That the Town agrees to pay a fifty per cent share of the maintenance costs of the subject automatic protection, and; 4. That the appropriate provisions be made in the 1983 Public Works Budget to accommodate this proposal . BACKGROUND AND REPORT: On February 22, 1982, Committee passed Resolution # GPA-177-82 in endorsement of Report No. WD-13-82, giving the following `s C L I WD —6-82 _ 2 _ ►��� direction: 1 . That the Town of Newcastle submit an application to the Canadian Transport Commission for the installation of automatic protection devices at the C.P. Rail Crossing located in Lots 22 & 23, Broken Front Concession, former Township of Clarke; and 2. That the Town' s portion of the costs be included in the 1983 Capital Forecast; and 3. That Staff be authorized to install advance warning signs on all three approaches to the crossing, as an interim safety measure. As a result of the foregoing, the Town wrote to the Canadian Transport Commission and, subsequently, the Commission requested C.P. Rail to prepare a cost estimate for the installation of flashing lights and warning bells at the subject Crossing. In addition, the Railway Company was asked to confirm that they are the junior authority at the location. By copy of a letter from C. P. Rail to the Canadian Transport Commission, and through confirmation in a subsequent telephone conversation to the latter authority, Staff has learned that the total costs involved are estimated at $55,250. 00. , of which the Town will be expected to pay 122% ($6,906. 25) and C.P. Rail 72% ($4,143. 75) , with the C.T.C. defraying the balance of $44,200. 00. Annual operating and maintenance costs are estimated at $1 ,200. , of which the Town will pay 50%. It is understood that the Canadian Transport Commission will be making a formal submission on the foregoing, to the Town, on the above; this report is presented, therefore, to assist in the preparation of assignment of funds in the 1983 Capital Budget, and to expedite the project procedure once official notification is to hand. Please refer to your letter of June 10, 1982 in connection with the crossing at the subject location. The Railway is junior at this crossing and therefore its prepared to pay 71' % of the cost to install the proposed automatic protection and 50% of the maintenance cost which is in accordance with :section 20 of the Pail Relocation and Crossing Act and is in accordance with the Committee 's current formula. Please find attached a detailed estimate of the cost to install and maintain two flashing light signals with extra light units and one bell at this crossing. Yours truly, G. P.
