SUBJECT: BILL 149. DISPOSAL OF SOLID WASTES
AT LANDFILL SITES.
RECOMMENDATION:

REPORT:
Bill 149 is a Bill to amend certain Regional Acts and, with respect
to the Regional Municipality of Durham Sections 3 and 9 have the
potential for impact on the Town of Newcastle.
Section 3 stipulates that the Region has the sole responsibility
for establishing solid waste facilities, and that area municipal-
ities may not provide such facilities. It goes on to state that
private disposal facilities may be established only with the j
Region's approval . This provides a consistent approach across
Durham and protects the financial integrity of the Region 's solid
waste jurisdiction. It does not, however, eliminate the potential
for savings by the Town by requiring that the Town's solid wastes
be disposed of at sites specified by the Region. Accordingly,
Section 3 is of little consequence to Newcastle other than in the
fact that it provides more opportunity for the longevity of
Regional sites and, therefore, the potential for continued disposal
of the Town' s solid wastes.

Section 9 speaks to routing of traffic to solid waste disposal
sites and specifies that, although an area municipality may pass
by-laws to prescribe such routes, such a by-law must be approved
by Regional Council . This could create problems for the Town if
the Region of Durham did not share the Town's concerns related to
traffic on a specific route; however, it is anticipated that a
co-operative effort would be made in such instances. In short,
this section of Bill 149 does present the potential for dis-
agreement between the Region and the Town, insofar as traffic
routing is concerned, but should not lead to too much difficulty
if approached and handled in the spirit of co-ordination and
common interests.
A copy of this report should be forwarded to the Region of
Durham as an indication of the Town's feelings in respect of
Bill 149.
