SUBJECT: CLOSURE AND CONVEYANCE OF A PORTION OF THE ROAD ALLOWANCE BETWEEN LOTS 16 & 17, CONCESSION 4, FORMER TOWNSHIP OF DARLINGTON. (-)/".�) RECOMMENDATION: It is respectfully recommended: 1 . That Report # WD-47-82 be received, and; 2• That the value of the lands comprising Parts 1 , 2 and 3, Plan 1OR-1466 be established at $4,575. 00 (Four Thousand Five Hundred and Seventy Five Dollars) per acre, and, further; 3• That, conditional upon the Applicant agreeing to convey Parts 2 & 3 to the Town, Part 1 , Plan 1OR-1466 be closed, by by-law, and con- veyed, in accordance with Town Policy. BACKGROUND AND REPORT: Report WD-20-82 to the March 22, 1982, General Purpose and Admin- istration Committee, detailed the reasons for an application to close and convey the southerly 174.79 ft. of the road allowance i between Lots 16 & 17, Concession 4, former Township of Darlington, namely to provide access onto a maintained road from the lands located in the south-westerly corner of Lot 16. 6A, lU 1(a� WD-47-82 - 2 _ In accordance with Town Policy and procedure, and upon Council 's approval of Report WD-20-82 by Resolution # C-266-82, a reference plan was obtained and, subsequently, an appraisal of the value of the land was acquired. During the course of the survey work it was discovered that, in order to give the Town a uniform width of 66 ft. on Green's Side Road, to which the Applicant requires access, it would be necess- ary for the Town to acquire the small areas of land shown as i Parts 2 and 3 on Plan 1OR-1466, and this can be accomplished at the same time as the Applicant acquires Part 1 for frontage pur- poses. The area of land comprising Part 1 is 3,554 sq. ft. , or 0.082 acres which, at a value of $4575.00/acre would cost the Applicant some $375. 00. The areas comprising Parts 2 and 3, Plan 1OR-1466, are 369 sq. ft. and 4 sq. ft. , respectively, which the Town wishes to acquire. By deducting the area of Parts 2 and 3 from the acreage comprising Part 1 , for purposes of value-balancing, the Applicant would be required to pay for a net total of 3,181 sq. ft. , or 0.073 acres, at a cost of $333. 00 (Three Hundred and Thirty-Three Dollars) . It is suggested that, upon the Applicant's confirmation of an exchange of lands, as detailed above, and acceptance of costs applicable to the purchase of Part 1 , this matter can proceed to it' s conclusion, in accordance with established Policy.
