ENG., DIRECTOR HAMPTON,ONTARIO TEL.(416)263.2231 LOB 1JO 987-5039 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF JUNE 14, 1982. REPORT NO. WD-46-82. SUBJECT: LOT 21 , ORONO ESTATES. INSTALLATION OF CABLE T.V. RECOMMENDATION: It is respectfully recommended: 1 . That the Mayor and Clerk be authorized to enter into an agreement with Pine Ridge Cable T.V. , for the installation, operation and maintenance of an under- ground television cable, to be installed along the south side of Lot 21 , Registered Plan No. 693. BACKGROUND AND REPORT: The Public Works Department has received a request from Dousery Consulting Limited, Consultants for Pine Ridge Cable T.V. , to install a buried cable along the south side of Lot 21 , Registered Plan 693, Orono Estates. A previous submission requesting permission to place the cable on the combined (twenty-foot) sewer and watermain Ease- ment on Lots 20 & 21 was denied as the Terms and Conditions of the Easement would not allow additional plant. Dousery Consulting Limited has sought permission to place the cable on private property, but has been unsuccessful in obtaining a right- of-way. It is felt that the proposed location, as submitted in this report, WD-46-82 _ 2 _ is the most suitable and will not interfere with the future development of Lot 21 . The Director of Community Services has no objections to the proposed location, and requests only that the area be restored subsequent to the installation works being completed. MacMicking, Manager, CATV Operations. Dear Sir: Re: Cable T.V. - Lot 21 , Orono Estates. Further to your letter of April 12, 1982, we have reviewed your proposal for the installation of T.V. service on Lot 21 , and will be recommending to Committee and Council that the Town enter into an Agreement with Pine Ridge Cable T.V. for the installation, operation and maintenance of an underground television cable. This will be placed along the south side of Lot 21 , Registered Plan 693, in accordance with the approved drawing. We would expect you to have your Solicitor prepare an Agreement for the proposed works, giving consideration to the following items: 1 . Design and location of the buried cable to be approved by the Director of Public Works. 2. Cable to be installed in a conduit to facilitate repair and replacement, with a minimum disturbance to the surface or future structures which may be erected on the property. 3. Complete restoration in kind for installation, repairs or alteration, to the satisfaction of the Director of Public Works. / 2 . . . Dousery Consulting Limited. June 4, 1982. 4. Construction to be in accordance with ,approved drawings , and to be inspected and approved by the Town of Newcastle. Prior to inspection, a forty-eight hour period of notice shall be given to the Town. 5. Provision of Liability Insurance, with the Town as co- insured; Pine Ridge Cable T.V. to indemnify and save harmless the Town of Newcastle from any claims, suits , damages, or consequences, now or at any future time, which may result from the installation, operation and maintenance of the cable system. 6. All costs incurred by the Town of Newcastle will be documented and defrayed by Pine Ridge Cable T.V. 7. Pine Ridge Cable T.V. to agree to relocate it's plant, at it' s own cost, if such relocation is required by the Town in the future development and/or use of Lot 21 , Registered Plan 693. 8. Pine Ridge Cable T.V. will obtain all necessary approvals from any other agencies having interest or jurisdiction. We trust the foregoing is satisfactory and will advise you of the outcome of our submission to Committee and Council in the very near future. Dear Sir: Please find enclosed 4 copies of our plan number 10, showing a pro- posed cable to service the subdivision at the north end of Orono. It is our understanding that Lot 21 is owned by the Town of Newcastle, and hence we request your permission to place this cable as described on the enclosed plan. We also understand that future plans for this lot are currently unde- termined. Should our proposal be acceptable at this time but not in the future, Pine Ridge Cable T.U. are quite willing to discuss relocation at their cost. We have proposed to place this cable in conduit at 2'0" north of the southerly property line in an effort to avoid any incon- venience to future construction on the subject property. In addition, please be assured that construction and restoration will be performed in a professional manner. Please do not hesitate to call if any questions arise.
