SUBJECT: CONSTRUCTION OF HOLT ROAD (ONTARIO HYDRO) LAND PURCHASE AND ACQUISITION. RECOMMENDATION: I It is respectfully recommended: 1 . That this report be received, and; 2• That a by-law be passed authorizing the Mayor and Clerk to execute Offers to Sell related to lands required for the reconstruction of Holt Road, between Highway 401 and Baseline Road, in the former Township of Darlington, between: (i) The Town of Newcastle and Helen Van Camp, for a portion of Lot 21 , Broken Front Concession, former Township of Darlington, and; The Town of Newcastle and Samuel Van Camp, for a portion of Lot 21 , Broken Front Concession, former Township of Darlington, and; (iii) The Town of Newcastle and Emil and Amalia Vandracek, for a portion of Lot 21 , Broken Front Concession, former Township of Darlington, and; 3• That letters of acceptance be forwarded to the Vendors, in accordance with the requirements of the Offers to Sell , and further; I 4• That the documents be forwarded to the Town Solicitor for completion of the transactions and registration of the documents. ���, WD-43-82. - 2 _ REPORT: The attached Report WD-27-82 provides background to the subject land purchase transactions. Regional Municipality of Durham Staff have been requested to acquire the necessary property, on behalf of the Town, and are proceeding well with negotiations. A total of five properties are affected, three of which are the subject of this report. A further property transaction will have an offer in the near future, and the last property required is progressing fairly well towards the stage of an offer being made. It is our hope to call for a contract for construction within the next month or two, therefore all land transactions should be final- ized as soon as possible. Respectfully submitted, R.G. Dupuis, P. REPORT NO. WD-27-82. SUBJECT: Construction of Holt Road (Ontario Hydro) . Land Purchase and Acquisition. RECOMMENDATION: It is respectfully recommended: 1 • That this report be received, and; 2• That Staff be authorized to retain the services of the Region of Durham Land Purchasing Division to negotiate the purchase of property to facilitate the proposed construction of Holt Road, and; 3• That all Land Purchase Agreements be brought before Committee and Council for approval . BACKGROUND AND COMMENT: Further to Resolution ;y HL-16-81 , Hydro Liaison Committee Meeting of December 17, 1981 : "THAT the design improvements required for Holt Road be undertaken in 1981 and that the remedial work required to be done on Holt Road be undertaken in 1982", the Town has rec- eived the approval of the Project Manager for Darlington Generating Station to proceed with the proposal , at an estimated cost of $247,000. 00 (Two Hundred and Forty-Seven Thousand Dollars) . I 1 i Some land acquisition is required and Staff have discussed this with the Region of Durham; the Land Purchase Division has agreed to negotiate the land transactions on behalf of the Town of Newcastle. Commissioner of Works Re: Agreements to Sell - Holt Road, Darlington Township Please quote our ref: Enclosed are duplicate "Offers to Sell " from Mr. Samuel LP-N-27-1 Van Camp and from Mrs. Helen Van Camp. I have advised the people that the Town will notify them directly of Council 's acceptance of .the agreements. Mr. S. Van Camp owns 27 acres of agricultural land just north of the 401 , extending north to the hydro right-of-way. Compensation indicated on the agreement is based on a market value of $4,000 per acre. Mrs. H. Van Camp owns a lot immediately adjacent to the hydro right-of-way. The lot measures 213.87' X 195' (irr.) and contains about 0.882 acres. The lot as though vacant was valued at $32,000.00 or $0.83/sq. ft. which also provided the basis of compensation indicated on the offer. I might add that the Van Camps are very concerned about the trees across the front of their property and would appreciate your cautioning the contractor to take the necessary precautions when constructing across the front of the house. i With respect to a survey plan of the required widening; I have contacted all the owners and don' t anticipate any grave problems settling with them. Commissioner of Works Re: Agreement for road widening along Holt Road - Vandracek - Part Lot 21 , B.F,C. , Please quote our ref: Township of Darlington LP-N-27-2 Enclosed is an offer to sell from Emil and Amalia Vandracek. I believe the terms and conditions of the agreement are self explanatory, however, if you have any questions, feel free to contact the undersigned. With respect to compensation, the widening is being acquired from a ten acre parcel and as such the land was valued at $5,000 per acre plus a sum of $500.00 for loss of landscaping across the front of the property in the vicinity of the house. I have advised the Vandraceks that the Town will want to monitor the water level of the well from time to time. A copy of the acceptance letter should be forwarded to John D.
