REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF MONDAY, MAY 3, 1982.
REPORT NO. WD-36-82.
SUBJECT: Farm Irrigation/Water Supply System.
Twin Brand Orchards Limited.
Lot 31 , Concession 2, former Clarke.
RECOMMENDATION:
It is respectfully recommended:
1 . That a by-law be passed authorizing the Mayor
and Clerk to enter into an Agreement with
Twin Brand Orchards Inc. , for the laying,
operation and maintenance of a water pipeline
along the Third Concession road allowance of
former Clarke Township, from Wilmot Creek,
easterly approximately 1 ,400 feet.
BACKGROUND AND REPORT:
Correspondence and a concept plan has been received from Twin
Brand Orchards Incorporated requesting permission to lay a plastic
water pipeline along the Third Concession of (former) Clarke
Township, in order to provide seasonal irrigation to new orchard
stock.
The Public Works Department has reviewed the subject proposal and
it is felt that, providing the facility is designed and installed
in accordance with Town direction and requirements , and that a
satisfactory Agreement related to the pipeline is legally in place,
the work may proceed. t�

The procedure for this project will be as follows:
1 . Submission of a draft Agreement, prepared by
the proponents ' solicitor, covering the items
detailed in the attached letter to Messrs.
Twin Brand Orchards Incorporated.
2. Review of the draft Agreement by the Public
Works Department and the Town Solicitor,
and revisions to the same, if necessary.
3. Execution of the Agreement.
The foregoing will be a time-consuming process which could well
defeat the proponents ; aim of having the system operational in
the summer of 1982. To circumvent this eventuality, it has been
indicated to Twin Brand Orchards Incorporated that the Town is
willing to consider an interim measure, such as a temporary pipe-
line laid in the ditch.

Dear Sir:
Re: Farm Irrigation & Water Supply System.
Lot 31 , Concession 2, former Clarke.
In response to your recent correspondence, this is to advise you
that this Department will recommend that the Town enter into an
Agreement with you in respect of the subject item. It is hoped
that we may be able to submit a report to the General Purpose &
Administration Committee, for recommendation to Council , in the
very near future.
In the meantime I would suggest that you have your Solicitor
draft an Agreement which should include the following items:
1 . Design and location of the pipeline to be approved by the
Director of Public Works of the Town of Newcastle, and all
restorations to be to the satisfaction of the Town.

2. Piping to be in accordance with Municipal standards for
plastic piping. While this Municipality is not involved in
the design of water services, we will look to the Regional
Municipality of Durham for guidance, specifically Mr. W.A.
Evans, Design Manager (Telephone 416: 668-7721) .
3. The pipeline is not to be attached to the bridge on the
Third Concession at Pollard Road in any way whatsoever. j
4. We would prefer that the pumping station be located on the
south side of the road.
5. A Road Occupancy Permit must be obtained from the Public
Works Department prior to the commencement of any works.

6. Construction is to be inspected by the Town of Newcastle
and, subsequently, approved by same.
7. To cover the Town' s costs for legal fees, engineering, etc. ,
a deposit of $500. 00 (Five Hundred Dollars) should accomp-
any the Agreement. The Agreement should also stipulate that
all costs to the Town exceeding this amount will be documented
by the Town and payable by Twin Brand Orchards Inc.
8. The Agreement should provide for liability insurance with
the Town stipulated as co-Insured.
9. Twin Brand Orchards Inc. will indemnify and save harmless
the Town from any claims, suits, damages, etc. , which may
result.
10. Twin Brand Orchards Inc. will assume full responsibility for
any damages to the road, or right of way of the road allow-
ance, or to private property, which may result from a mal-
function of the pipeline during it's operation in subsequent
years.
11 . Twin Brand Orchards Inc. will relocate, at it's own cost, said
pipeline, if such relocation is necessitated at a future date
as a result of works on the road undertaken by the Town.
It is obvious that the process involved here could be fairly time-
consuming and could defeat your goal and date of commencing oper-
ations so, in the interim, I would be pleased to discuss your
proposal with a view to using a pipeline in the ditch, or some
similar arrangement.
As I have. indicated I will recommend Council 's endorsement of the
pipeline proposal , and will await the submission of your draft
Agreement. Should you wish to pursue the possibility of interim
measures, please do not hesitate to contact me.

For Twin Brand Orchards Ltd.
Gentlemen:
Twin Brand Orchards Inc. wish to install a water supply system to
provide seasonal irrigation to new orchard stock commencing in the summer
of 1982. The farm is situated in part of Lot 31, Concession 2 of Clarke
Township, within the geographical Town of Newcastle.
To provide adequate water supplies, it is proposed that a buried,
3-inch plastic pipeline deliver water from Wilmot Creek to an existing
pond on the farm, a distance of approximately 3,000 linear feet. Approx-
imately half of the pipeline would be situated on the road allowance
between Concessions 2 and 3. Details of the water works route and
construction are outlined on the accompanying plan.
Accordingly, Twin Brand Orchards Inc. submit this proposal for
your consideration and wish to enter into an agreement and to hold
harmless the Town of Newcastle due to actions related to the installation
and operation of the proposed private water supply works. Following
acceptance of the proposed works and any attached conditions by the
Town, Twin Brand Orchards would advise the Works Department prior to the
initiation of construction to facilitate construction inspection.
