REPORT NO. WD-20-82. SUBJECT: ROAD ALLOWANCE BETWEEN LOTS 16 & 17, CONCESSION 4, FORMER DARLINGTON. RECOMMENDATION: It is respectfully recommended: 1 . That this report be received, and; 2. That the southerly 174.79 ft. of the road allowance between Lots 16 & 17, Concession 4, former Township of Darlington, be closed by by-law and conveyed to the abutting owner, in accordance with Town Policy, and; 3. That the applicant be so advised. BACKGROUND AND COMMENT: In December of 1981 the Town was approached and requested to close and convey a portion of the subject road allowance, in order that the abutting property on the easterly side would achieve access onto a maintained road (Green Road) . At the present time, the existing parcel of land, although abutting Green Road, does so by only four feet and does not, therefore, meet frontage and access requirements. The Planning Department was approached and requested to comment on the applicant's proposal , subsequently advising that there were no foreseeable implications, either in closing the southerly 174:19 ft. , or, in fact, in the closure and conveyance of the balance of the road allowance. WD-20-82. - 2 _ In order to provide the property with the potential for access and, ultimately, allow the owner to build a dwelling on same. it is recommended that the application be approved. SUBJECT; '7 Road Allowance between Lots W& � Concession 4, former Darlington. Application to Close & Convey (WILLIS) . With reference to our letter to Mr. Thomas A. Newman (Dated February 9, 1982), which was copied to you, could you please provide any comments you may have on the proposed closure and conveyance of the small (southerly) section of the subject road allowance, as indicated on the attached plan of survey. Also, would you think it would be advantageous to the Town to propose the closure and conveyance of the entire road allowance? It appears that the Willis Family is the only abutting owner, and it hardly seems practical for the Town to retain the lands in their present state. Application on behalf of Mrs Annie G Willis Thank you for your letter of January 28, 1982, enclosing $500. 00 in deposit, on behalf of your client, Mrs. Annie Gertrude Willis, for the closure and conveyance of a portion of the subject road allowance. So far as has been determined to this point in time, you may well be correct in your assertion that the closure and conveyance of the small area of the road allowance would not affect any other property owners and this would, of course, hasten the formal pro- cedure considerably. Now that you have filed formal application on behalf of your client, we will take immediate steps to acquire the necessary Reference Plan, and request input from other Town Departments to ensure that the closure and conveyance will be in order with any future requirements which may be necessary in order to gain a viable building lot; once these initial stages have been com- pleted, we shall submit a report and recommendation to the General Purpose & Administration Committee. The actual timing is difficult to predict, but I will be sure to advise you as and when the matter is dealt with- at Committee level . i If there is a favourable recommendation to close and convey the lands, the next step will be the acquisition of an Appraisal of Land Value; this involves some slight delay and it has been the Town' s recent experience that it takes approximately two months to obtain the written Appraisal Report. However, upon -it's receipt, and the establishment of the value of the land, by Committee and Council , there only remains the advertising (four weeks) and preparation and execution of the legal documents. I think it would be fair to estimate at least six (6) months to the finalization of the transaction, if approved. Dear Sirs: - Re: Willis and Application for Closure and Conveyance of Municipal Road Allowance Between Lots 16 and 17 , Concession 4 , Town of Newcastle (formerly Township of Darlington) We are solicitors for Mrs . Annie Gertrude Willis and for the estate of her late husband, Harold Willis, the owners of Parcels A, B, C, D, E and F as shown on the en- closed Plan of Survey of Part 'of Lot 15 and 16 , Concession 4 , Town of Newcastle (formerly the Township of Darlington) . Mrs. Willis is considering the sale of some or all of the parcels shown on the enclosed survey and in this connection has engaged the services of Mr. J . Jeron- imo of W. Frank Real Estate Limited for the purpose of ascertaining values for the various parcels . We are advised that Mr. Jeronimo has made certain inquiries from the Town of Newcastle, specifically Parcel A and your requirements as to frontage and access in order to obtain a Building Permit for this particular parcel. Enclosed please find a photocopy of a photocopy of a letter addressed to Mr. Jeronimo from your Mrs. Haigh, dated December 18th, 1981 . We telephoned and spoke to Mr. Dave Gray on January 26th, 1982 , who advised that you do not have formal application forms for the closure and conveyance of municipal road allowances and that a letter setting out our request in this regard and details thereof, would suffice, along, of course, with a cheque for $500 . 00 . l rYC'11tr71t ` Page 2, . . . . . . . . . / Please therefore consider this letter an application on behalf of our client, Mrs. Annie Gertrude Willis, for the closure and conveyance of that portion of the unmaintained road allowance on the westerly boundary of the South 174 .79 ' of Parcel A, shown outlined in Red on the enclosed copy of the Plan of Survey of Part of Lot 15 and 16, Concession 4 , Town of Newcastle. May we ask you please to take the appropriate steps to obtain the recommendation of your staff and, in due course, the adoption thereof by Committee and Council. In view of the fact that there are no abutting owners, we presume that no written concurrence with the closure and conveyance will be necessary and that if your staff, after considering the matter, approves, you will pro- ceed with- the placing of a Reference Plan on title and the acquiring of an appraisal. May we ask you please to advise as to how long it will take to process this application, assuming, of course, that the recommendation of your staff will be favourable. Edwards, M.C. I.p. , Deputy Director of Planning. FROM: V. Haigh, Secretary. SUBJECT: Road Allowance between Lots Concession 4, former Darlington. (South-west corner of Lot 16) . DATE: December 18, 1981 . A request has been received, from Mr. J. Jeronimo of W. Frank Realty Limited, that access approval be given in respect of the lot outlined in red on the attached sketch. Presently the lot has a legal frontage onto the travelled road of between four and five feet; there is an existing entranceway (installed by the Town) and for the requirements of this Depart- ment, an access permit could be approved. However, it is under- stood that Planning requires a frontage of 150 ft. , onto a maintained road allowance, prior to the consideration of a building permit, etc. , and this, of course, the applicant does not have. It would seem that, rather than require the applicant to upgrade a section of the unmaintained road allowance abutting the lot, It would be more simple to allow him to purchase the triangle of ' land (shown in green) between his property line and the presently travelled road. This would possibly entail the closure and convey- ance of the whole, road allowance but, so far as this Department is concerned, we have no plans or proposals in respect of the unmaintained right-of-way and it may well be advantageous to the Town to convey same. Would you please advise Mr. Jeronimo of any terms and conditions his client would have to meet in order to satisfy the requirements - of your Department? Thank you. cc: D.T. Dear Sir: Re: Road Allowance between Lots 16 & 17, Concession 4, former Township of Uarlin ton With reference to your recent enquiry regarding the availability of an approved Access Permit to your client's property, located as above, this is to-advise you that the site has been inspected and, while the existing entranceway would satisfy the requirements of this Department, there is not sufficient frontage to the property to meet the requirements of the Planning Department and, therefore, your client would not be able to obtain a Building Permit under the existing circumstances. It is suggested that, rather than submit a proposal to upgrade the necessary section of the road allowance, it may well be more economical and satisfactory for your client to submit a formal application to the Town requesting the closure and conveyance of that portion of the unmaintained road allowance which abuts the easterly 174 ft, of the property. For your information we are attaching a copy of the Town's Policy in respect of the Closure and Conveyance of Municipal Road Allow- ances, and we are taking the liberty of circulating your enquiry to the Planning Department for their input as to all requirements necessary in order to permit a building on the property. We trust this will be of interest and assistance to your client but, should you have any queries on this matter, please do not hesitate to contact this office.
