REPORT NO: WD-19-82. SUBJECT: RILLS OF LIBERTY NORTH SUBDIVISION. NO. 18T-77123. PART LOT 11 , CONCESSION 3, FORMER TOWNSHIP OF DARLINGTON. REQUEST FOR LETTER OF CREDIT REDUCTION. RECOMMENDATION: It is respectfully recommended: 1 . That this report be received, and; 2. That the request of East Woodbridge Developments Limited to have the Performance Guarantee for the install- ation of Works, reduced from $652,256. 00 to $303,530. 00. , be approved. BACKGROUND AND COMMENT: On July 29, 1981 , in accordance with the Subdivision Agreement between the Town of Newcastle and East Woodbridge Developments Limited, the Authorization to Commence Works was granted. To date a considerable portion of the construction has been completed, up to a point where Building Permits may now be issued in the first stage. The Works installed have been inspected and certified as having been constructed in accordance with the approved Engineering Drawings and Town of Newcastle Standards and Specifications. WD-19-82. The Developer has entered into an Agreement with Ontario Hydro for the installation of electrical services, and the Performance Guarantee for this work is by way of a separate Letter of Credit held by Ontario Hydro. Since all of the works have not been installed, the Town is not in a position to provide a Completion Certificate for the Works. East Woodbridge Developments Limited has requested that the Letter of Credit held by the Town as Performance Guarantee in respect of the construction of the Works be reduced by 90% of the value of the works completed to date, and that the Letter of Credit be adjusted to reflect the separate Performance Guarantee with Ontario Hydro for the underground electrical distribution. We have reduced the Hydro component of the original letter of credit to the amount of the streetlighting since the balance of the Hydro work is covered by separate agreement and letter of credit with Ontario Hydro: The estimated costs for streetlighting are as follows: Stage A $ 10,750.00 Stage B 15,050.00 Stage C 12,900.00 In view of the fact that the streetlighting is such a totally separate item from the roads and stow drainage, we ask your consideration be given to providing a separate maintenance for the streetlighting.
