WD-12-82. SUBJECT: Aggregate Sources and Transportation Routes. M.T.C. Contract No. 80-03. RECOMMENDATION: It is respectfully recommended that the following resolution be forwarded to Council for approval : "THAT WHEREAS the Ministry of Transportation & Communications has identified numerous sources, within the Town of Newcastle, from which aggregates may be drawn during the performance of the contract to reconstruct certain sections of Highway 401 and Highway 35/115, and; WHEREAS the transportation of aggregates may incur an impact on Municipal roads and the environment, and; WHEREAS the Ministry of Transportation & Communications has indicated that any roads which suffer a detrimental impact as a result of being used as haul routes shall be maintained in, and restored to, a condition satisfactory to the Municipality; BE IT RESOLVED THAT the Town of Newcastle approves the proposal of the Ministry of Transportation & Communications relative to the sources and transportation of aggregates to be utilized in highway reconstruction during 1982, subject to there being no financial or environmental impact on the Municipality either during, or at the completion of, the contract, and; BE IT FURTHER RESOLVED THAT, upon the determination of the specific sources of aggregates to be used, and the establish- ment of the haul routes therefrom, the Town of Newcastle and representatives from the Ministry of Transportations & Comm- unications and the Ministry of Natural Resources, meet to assess the original condition of those Municipal roads in- , volved and, further, that the Town of Newcastle monitor and `� report on the impact thereon during the performance of the contract." `'� ' � WD-12-82 - 2 _ BACKGROUND: i In 1976 the Town of Newcastle was asked by the Ministry of Transport- ation & Communications to approve a proposal to reconstruct Highway 401 , from Oshawa to Highway 35/115. In 1979 a similar project for the improvement of Highway 35/115, from Highway No. 2 to Enterprise Hill , was put forward; both proposals received Town of Newcastle approval . In 1981 Highway 401 was reconstructed from the Oshawa-Newcastle Boundary to Waverley Road, and the remain section to Highway 35/115 was scheduled as a 1982 project. The Ministry has now advised that it intends to proceed with the re- construction of Highway 401 , for a distance of 2.95 miles to the 35/115 interchange, and of Highway 35/115 from Highway 401 to the Highway 2 interchange, a distance of 1 .59 miles which will initiate the project to reconstruct to Enterprise Hill . Prior to the advertising of the construction contract the Ministry of Transportation & Communications has, in the past, requested Municipal approval of Sources of Aggregates located within the Town of Newcastle. REPORT: In the attached correspondence from the Ministry, thirty-eight (38) possible Sources of Aggregates are proposed, some of which, if used, would involve the utilization of Town roads as haul routes to the construction site(s) . It is to be expected that such roads are quite likely to suffer from the concentration and volume of heavy truck traffic, and, too, environmental problems associated with noise and dust pollution may well occur. The Ministry of Transportation & Communications is well aware of the possibility of these impacts and, has guaranteed to rehabilitate the roads to their original condition, at Ministry expense, as required and agreed to by the Town. It is suggested that the Town give preliminary approval to the proposal and that, upon the contract award, Staff meets with rep- resentatives of the Ministry of Transportation & Communications, the Ministry of Natural Resources and the Regional Municipality of Durham, to ascertain and establish the routes to be used for haulage, and assess the condition to which they must be maintained during, and rehabilitated after, the performance of the reconstruction contract. WD-12-82 - 3 - In the list of proposed Aggregate Sources are included several pit operations which are not, at the present time, licensed. The Ministry has advised that, in the event any of these non-licensed pits are used by the successful contractor, the latter would re- quest the Town to issue a Wayside Permit if material is extracted. The Ministry of Natural Resources will monitor the extraction of materials from those pits used, and will ensure that effective rehabilitation is carried out. The sum total of materials expected to be required for the recon- struction of the sections of Highway 401 and Highway 35/115, as detailed above, are as follows: 160,000 tons Granular ' C' (Pit Run) 101 ,000 tons Granular 'A' (Crushed) 100,000 tons Hot Mix Aggregates. Clerk, Town of Newcastle, 40 Temperance Street, Bowmanville, Ontario. — Ll C 3A6 Dear Sir: Re: Aggregate Sources List For Contract 82-03 The Ministry has scheduled the reconstruction of Highway 101, from east of Waverly Road to Highway 115 and 35, 2.95 miles and the reconstruction of Highway 115 and 35, from Highway 101 northerly 1.57 miles. It is anticipated that tenders for this work will be called in the near future. The quantities of granular type materials required for this work are 160,000 tons of pit run (Granular "C")material, 101,000 tons of crushed material (Granular "A") and 100,000 tons of hot mix aggregates. The Permit is contingent on the rehabi- litation of the source selected to pre-determined standards. The Town also has the MTC's guarantee that Town roads utilized as haul routes from these non-licensed sources to the project will be rehabilitated to their original condition at MTC' s expense as required and agreed to by the Town. The Aggregate Sources List will form part of the contract documents and the successful contractor will assume he can utilize any of the sources listed for his granular requirements assuming that quality requirements are met, and suitable arrangements are made with the pit owner. As such, this document is presented in order to give the Town an opportunity to review the information and convey your comments back to the Ministry prior to the award of the contract. Due to the relatively short time prior to the adverti- sing of this project, I request any comments be forwarded to this Office by February 24, 1982• Should such infor- mation or notification of same not be received, it will be assumed the Town agrees in principle with the MTC proposals. Should, however, the Town feel, after studying the attached information, that further discus- sion is required, I would be pleased to meet with you and a representative from MNR at your convenience.
