Director's Report to Public Works Committee of January 20, 1981.
ITEM: WD-10-81.

SUBJECT: Road Allowance between Lots 32 & 33, Concession 7,
former Township of Darlington.
BACKGROUND:
Pursuant to Council's approval of the closure and conveyance of
a portion of the road allowance in Lots 32 & 33, Concession 7,
former Darlington, more particularly described as Parts 5 & 6,
Reference Plan 1OR-1234, a request has now been received that
the Town convey Part 3, which is a small area of one-foot res-
erved.
REPORT:
It will be seen on the attached Plan 1OR-1234 that the (approx-
imately) 56 ft. of one-foot reserve is located directly between
Parts 1 & 6, now privately owned.
It is unlikely that the Town would benefit from retaining the
one-foot reserve, which is too insignificant to have land value.
RECOMMENDATION:
THAT the one-foot reserve be removed from that portion of the road
allowance between Lots 32 & 33, Concession 7, former Township of
Darlington, described as Part 3 on Plan 1OR-1234 and, further, that
this area of land be conveyed, at no consideration, as requested,
conditional upon there being no costs borne by the Town of Newcastle.

Thank you for your letter dated December 18, 1980 and also for
copy of letter sent to Sims, Morton, McInerney & Brady on the
same date.
With regard to the cheque, please contact Mr. McInerney with
regard to the payee.
With regard to the further requests of A. Geisberger and Sons,
I am referring a copy of your letter to the Director of Public
Works for a recommendation through the Public Works Committee
and Council.
We shall advise you of the outcome, in due course.

I enclose a photocopy of my letter to the solicitors
for the Town of Newcastle together with related enclosures..
Would you kindly advise as to who the cheque for
$1, 170.00 is made payable so that A. Geisberger and
Sons Farming Partnership can obtain a conveyance of
parts 5 and 6, Plan 1OR-1234.
Further, my clients desire to obtain a reconveyance
of part 3, Plan IOR-1234 from The Corporation of the Town
of Newcastle. Part 3, Plan IOR-1234 at present is a small
portion of a one foot reserve previously conveyed to the
Town of Newcastle by instrument number 95881, secondly
described and extends from the north boundary of part 4
Plan lOR-1234 to the north boundary of Lot 33, .Concession 7,
Geographic Township of Darlington.
A. Geisberger and Sons obtain permission of the Land
Division Committee for the Regional Municipality of Durham
to convey to a Mr. and Mrs. Dent Hansen parts 1, 21 3, and 6,
Plan 1OR-1234 to permit a readjustment of their lot lines.

! I am therefore writing to request that parts 5 and 6,
plan 1OR-1234 be conveyed to A. Geisberger and Sons
Farming Partnership for the total price of One Thousand
One hundred and Seventy Dollars as per resolution of
council as enclosed and as established in the appraisal
of R. Timbers. In addition, I am requesting that
part 3, Plan 1OR-1234 be conveyed to my clients.

Further to our telephone conversation, I now enclose
photocopy of letter dated October 26th, 1978 from Gertrude E.
Gray which sets out the council resolution pertaining
to this situation.
I further enclose copy of letter dated November 17th,
1978 from Mr. J. M. Mci.Lray.
I further enclose copy of letter dated June 8th, 1979
which indicates the appraisal of the property is One Thousand
One Hundred and Seventy Dollars ($1, 170. 00) and same has been
accepted by council.
As indicated in our previous letter we are further
requesting conveyance of a few feet of the one foot reserve
as it would be in the middle of the lot conveyed to Mr. and
Mrs. Hansen.
I would ask that the piece of the one foot reserve as
defined on Plan 1OR-1234 be conveyed without consideration.
With regard to the latter conveyance I have by separate letter
