SUBJECT: Road Allowances between Lots 28 & 29, and Lots 29 & 30,
Broken Front Concession (Clarke) former Village of
Newcastle.
BACKGROUND--& REPORT:
Attached is a request, received and forwarded by the Town Clerk,
from the Solicitor acting for Windsweep Farms Limited that the
Road Allowances between Lots 28 and 29, and Lots 29 & 30, be
closed and conveyed to their Client.
A review of Town files discloses that the Road Allowance between
Lots 28 & 29, Broken Front Concession, former Clarke, was closed
and conveyed by By-Law Number 352, dated March 13, 1899, and
conveyed to the abutting owners.
The status of the road allowance between Lots 29 & 30 is that
it is an unopened road allowance owned by the Town of Newcastle.
In comments on Windsweep Farms' Application for Rezoning, dated
August 29, 1980, the Public Works Department expressed concern
"that any road allowance within, or abutting, the development be
closed by By-Law and deeded to the abutting owner, if this has
not already been done, in accordance with Town Policy".
RECOMMENDATION:
THAT the matter of the closure and conveyance of road allowances,
as requested by Windsweep Farms Limited, be considered as a
condition of the Subdivision Agreement and in accordance with
Town Policy.

Ontario Limited and Windsweep Farms (1965) Limited, I would
ask that the Town of Newcastle pass a bylaw closing the
unopened road allowances between Lots28 and 29 and 29 and 30
with respect to the Broken Front Concession in the Village of
Newcastle and that the appropriate authorization be included
in that by-law effecting the conveyance of those lands to my
clients, being the adjacent owners.

Further to our discussions regarding the status of the above road
allowance, this is to advise you that the same, being between Lots
28 and 29, Broken Front Concession, was closed by By-Law No. 352,
from the Lake northerly to the Base Line Road and conveyed to the
abutting owners.
The road allowance between Lots 28 & 29, Concession 1 to Clarke
Street is owned and maintained by the Town of Newcastle; however,
the road allowance known as the Base Line Road in Lots 29 & 30 is
unopened and, to my knowledge, owned by the Town of Newcastle.
I trust the foregoing; information will be of assistance to you.

Further to your enquiry regarding the status of the abovenoted road
allowance, this is to advise you that, to the best of my knowledge,
the road allowance known as 'Baldwin Street' has been closed by By-
Law, commencing at the lake, northerly, to a point where the Region
of Durham obtains access to their Sewage Disposal Plant.
For your further information, the subject street is maintained from
the Regional access point, northerly, to Clarke Street.

you.

We have now reviewed the subject Application for Rezoning which is
not of any great concern to the Public Works Department. However,
