Director's Report to Public Works Committee of January 20, 1981.
ITEM: WD-4-81.

SUBJECT: Lots 69 to 82, Perry's Plan of Hampton.
BACKGROUND:
The subject lots front those portions of Elgin Street and Simpson
Avenue, Hampton, which are unopened, and the attached correspond-
ence is enquiring if building permits would be available for the
lots and/or what improvements would be required for same.
REPORT:
The Planning Department has submitted comments (also attached)
which indicate that the subject lots are exempt from certain by-
law restrictions, with the exception of the By-Law for Property
Access.
Prior to the issuance of an entrance permit, any lot must front
an improved and maintained public roadway.
RECOMMENDATION:
THAT the writer be advised that improvements are required to
Elgin Street and Simpson Avenue (Hampton) fronting Lots 69 to
82 and, further, that Design Standards be provided, from which
the Owner's can obtain cost estimates.

Dear Sir:
We have currently listed and are offering for sale
a parcel of property owned by Ercole Magnone and Maria
Rochetta in the Village of Hampton.
As shown on the sketch attached, these dsuu ,bjeect 82
parcels comprise Lots 69 and 70, 79 and 80,
Perry's Plan.
The owners have asked us to enquire on their behalf
if building permits would be available and what improvements
and costs would be involved in providing services to these
lots.

Attached is copy correspondence and a sketch indicating the
geographical location of the subject lots. The owners thereof
are enquiring if Building Permits are available, and what im-
provements and costs would be involved in the provision of
services.
Elgin Street is unopened east of Perry Avenue, and Simpson
Avenue is only open fronting Lots 83, 84, 85 .
Prior to a report to the Public: Works Committee, it would be
of assistance if you would forward comments on this matter,
and advise as to whether the Lots conform to the Development
Plan, etc.

SUBJECT: Lots 69 and 70; and 79-82, Perry's Plan, Hampton
Further to your request, I have reviewed the applicable
provisions of the Darlington Zoning By-law, and offer the following
comments.
These lots are whole lots within the Perry Plan of
Hampton, which was "deemed" by By-law 77-47. However, the assess-
ment rolls indicate that lots 69, 80 and 81 are owned by Mr. Magnone
and lots 70, 79 and 82 are owned by Ms. Rochetta; and therefore no
severances would be required to permit the development of these six
lots.
The lots are presently zoned "Deferred Development" in
the Darlington Zoning By-law. The lots do not comply with the lot
frontage and area requirements of the By-law, but are exempt from
these provisions by subsection 4(e) of the By-law.
Elgin Street is designated a Class 'B' Public Street
in the By-law, and both Elgin and Simpson Streets have road allowance
widths of less than 66 feet. Under normal circumstances, building
permits would not be available for single family dwellings on lots
abutting such roads; but lots fronting on Elgin and Simpson Streets are
exempt from the requirements of subsection 4(f) and are eligible for building
permits.

In my opinion, the only impediment to the issuance of
building permits to these six lots would be the refusal by the Town
to issue the necessary Entrance Permits and/or by the Durham Health
Unit to issue the required Septic Tank Permits. Since these road
allowances are presently unopened, it is assumed that Entrance Permits
would not be issued until the road had been constructed to the Town's
requirements.
