BACKGROUND: The owner of property located on Part of Lot 16, Concession 3, former Clarke, in correspondence directed to Councillor Hamre, complained about the volume of truck traffic, using the road known as "Morgan's Road". The main concerns expressed are relative to the number of trucks, excessive speed, noise and littering. As the latter three complaints are matters which fall under the jurisdiction of law enforcement, this report will address the overall concern of trucks using the road as a regular route. REPORT: Initially it would seem that the obvious solution to this matter would be to prohibit the use of the road by heavy trucks. While this step could be taken, the inherent related problems are complex and merit careful deliberation. The road allowance in question is of a higher standard than, for example, the 4th Concession, and from a standpoint of service and quality is the superior route. Also, Morgan's Road, as is usual for roads maintained by the Town of Newcastle, is desig- nated for "Public Use as a Public Highway", in accordance with the Highway Traffic Act. As such, only the passing of a by-law to 'Prohibit Heavy Traffic' would alleviate the problem under review. If a Municipality stipulates, by by-law, that any road allowance is restricted from use by heavy traffic, then an alternate route must be designated as a Truck Route and this action would, in turn, create an impact on the alternate road allowance(s) , and the property owners in the immediate vicinity. Also, any roadway designated as a Truck Route would have to be maintained at a high standard to withstand such constant usage as would occur. WD-25-81 (2) RECOMMENDATION: THAT WHEREAS the road allowance in Lot 16, Concession 3, former Clarke (Morgan's Road) is, in accordance with The Highway Traffic Act, designated for Public Use as a Public Highway, and is of superior standard in comparison to other area roads, no action be taken to prohibit the road for use by Heavy Traffic and the correspondent be so advised and, further, that matters in res- pect of speeding, noise pollution and littering be referred to the appropriate agencies for information and action. f
