Subject: Cean Investments Limited - Subdivision. (High Street, Bowmanville) . Storm Drainage. Recommendation: THAT storm drainage within the Cean Investments proposal and/ or the immediate watershed, be accommodated by means of a storm sewer outfalling at Liberty Street, independent of the Canadian Pacific Railway drainage works. Report: In 1975 Cean Investments made application for a plan of sub- division on lands lying north of the C.P.R. tracks and east of High Street in Bowmanville. The subdivision did not proceed due to lack of water supply and sanitary treatment facilities. Preliminary engineering drawings were presented in 1979 util- izing an open storm drainage channel from the north limit of C.P.R. lands to the existing storm sewer on Liberty Street. This concept did not meet Town Standards and Design Criteria for storm drainage. Following several meetings with the Developer, his engineer and Works Staff, Director's Report WD-83-80 was prepared for Committee resulting in Council adopting the following recomm- endation on July 3, 1980: THAT stwtm dna t.nage within the Cean Investment6 pAopo,sat and/on the immed�ate watershed aaea, be accommodated by means o4 a Istanm zewers and, 4u&thek, that this zha t become patrt o4 the Devetopen'ls agreement." On January 15, 1981, W.T. Dempsey Limited submitted a storm drainage proposal to the C.P.R. for their approval. A reply dated March 9, 1981, from J.O. Norwood, Division Engineer, C.P.R. , states that the railway prefers a redesignated storm sewer independent of their own drainage works and in accord- ance with their conditions and specifications. f/ J AA � WD-69-81 (2) Following an informal meeting with members of the Public Works Committee and Staff, Mr. Zygocki expressed his concerns regard- ing delay in his subdivision progress and a verbal report was presented to Committee April 14, 1981, resulting in Resolution # W-120-80: "THAT Sta44 bking back a upoitt to the next Meeting negoAding the matters bnuught 4oAwatcd by Mn. Zygocki,, Cean Investmentz." On Friday, May 1, 1981, Chairman Taylor and Works Staff met with representatives of C.P. Rail, on the site, to review the existing storm drainage and to investigate alternative pro- posals which would allow Cean Investments to proceed. These alternatives are: 1. To allow Cean Investments to construct a complete storm drainage system within the subdivision, out- falling into the existing watercourse, back of C.P.R.. tracks. * This proposal does not comply with Town Standards and Design Criteria and is not endorsed by C.P.R. representatives. The Minister of Housing conditions of Draft Approval dated August 5, 1980, pertaining to this problem are: " THAT the Owner agrees in writing to satisfy all the requirements, financial and otherwise, of the Town of Newcastle, concerning the provision of roads, installing of services and drainage" if THAT the Subdivision Agreement between the Owner and the Municipality contain the following provisions, wherein the Owner agrees: to ensure that there is no increase or changes of direction in the flow of natural surface drainage which would adversely affect the C.P. right- of-way. - that any proposed utilities under or over, crossing the C.P. right-of-way to service the resid- ential development are to be designed in accordance with C.P. Railway specifications and must receive WD-69-81 (3) C.P. Railway approval and be covered by C.P. Railway's Standard Agreement. 2. An independent storm sewer system be designed and constructed by the Developer under the Railway to outfall at Liberty Street. The latter alternative would be subject to the following: (a) C.P. Rail approval. (b) Town of Newcastle's Engineering Design Standards and Approval. (c) Region of Durham Approval (Liberty Street storm sewer) . (d) Granting of easements from north side of the C.P.R. right-of-way to Liberty Street. DTG:vh I
