Director's Report to Public Works Committee of April 14, 1981.

Subject: Mary Street, Burketon.
Recommendation:
THAT, subject to all of the following conditions being met, an
Application for Property Access be approved:
1. The Owner deed to the Town of Newcastle, free and
clear of all encumberances, an eight foot ( 8 ft.)
strip of land along the north side of Mary Street,
Burketon, from the east limit of the property
(Park Lot K, Plan File 80193-SK, being Part of Lot
20, Concession 10, former Township of Darlington) ,
westerly, to the road allowance between Lots 20 &
21, Concession 10, Darlington.
2. The Owner deed a one-foot (1 ft.) Reserve around
the perimeter of the subject property, except for
the location of the actual access.
3. That the Access Permit be granted solely in respect
of Residential use.
4. That the Owner request the Planning & Development
Department to consider an amendment to By-Law 2111
to exempt Mary Street, Burketon, from Cartwright
Street, westerly to a point eighty feet (80 ft.)
west of the east boundary of the property.
_ Report:
Attached is information which is all relevant to a request that
an Access Permit be granted in respect of Park Lot 'K' and 'L' ,
Burketon. Park Lot 'K' fronts a street allowance known as Mary
Street, Burketon, which is approximately fifty feet (50 ft.) in
width.

By-Law 2111 indicates that Mary Street is 'Improved' ; however,
it is not sixty-six feet (66 ft.) in width, nor is it totally
'Maintained' , by reason of an encroachment of a dwelling house
(which encroachment was recently approved by Council) .
The attached Staff comments are in relation to this matter and
it is suggested that, in addition to same, an amount of $460. 00
(Four Hundred and Sixty Dollars) be paid to the Town in respect
of minor improvements to that portion of Mary Street which will
provide access to Park Lot W .

filed at this Office earlier this week, this is to advise you
that Council, On March 10, 1981, dealt with a request received
from Ms. KcIli-e McDonell relative to the redesignation of Mary
Street and, as will be seen from the attached , the matter was
referred to the next Meeting of the Public Works Committee to
be held on April 14, 1981.
Due to the complexity of this matter, and the likelihood that
there may he the necessity to meet various Town of Newcastle
requirements relative to the Planning o & Development function,
as well as thLs. Department, it is felt advisable that the proc-
essing of your Application be held in abeyance until after the
CunnniLtee hzis had the opportunity to deliberate on same.
You will be advised, at a later date, of the outcome of Public
Works Commitct2e and any subsequent Council action relative to
the foregoing.

Park Lot K, Mary Street, Burketon.
DATE: March 27, 1981.
As requested, a review of the subject Application and site
has been undertaken, and the following comments apply:
1. Subject to the Applicant meeting any and
all requirements of the Planning & Dev-
elopment Department, access could be
approved, on condition that:
(a) The Owner deed to the Town of Newcastle,
free and clear of all encumberances, an
eight foot (8 ft. ) strip of land along the
north side of Mary Street, from the east
limit of the property, westerly, to the
road allowance between Lots 20 & 21, Con-
cession 10, Darlington.
(b) The Owner deed a one-foot (1 ft.) Reserve

2• The Planning & Development Department should
be requested to consider an amendment to

I understand that the subject matter has been referred, by the
Clerk, to the next Meeting of the Public Works Committee to be
held on April 14, 1981, and would suggest that formal approval
of the Application for Property Access be held in abeyance, pen-
ding the outcome of Committee deliberations.

Re: Part Lot L and Part Lot R,
Burketon Station
Further to your letter of March 10, 1981, please
be advised that on a number of occasions, I have had discussions
with both Mrs . McDonell and the Town's Works Department in respect
Of the above rioted property.
As you are no doubt aware, the subject property, which
is zoned R3 - Residential, fronts onto Mary Street which is designated
as an improved road by Restricted Area By-law 2111, as amended. However,
Section 4 (f) of said By-law stipulates that no building or structure may
be erected within any zone, unless it fronts on an improved public street
which leas a right-of-way width of 66 ' or more. Mary Street has a right-
of-way width of only 50` . In that regard, a rezoning to exempt this
road would be required prior to the issuance of any building permits .
There are two possible alternatives for initiating such
a rezoning. The first would be to submit an application for rezoning
directly to this office, accompanied by the applicable fee. The second
would be to request the Work's Department to recommend to Council,
through Public Works ConLnittee, that this portion of Mary Street be
exempted from the right-of-way width requirement; and that the Planning
Department be requested, by Council, to prepare and forward the necessary
by-law amendment.

In both instances, the comments and recommendations of
the Works Dt_,partment, Public Works Committee and Council are a pre-
requisite t-) this preparation of a by-law amendment. However, in
this particular case, the matter is further complicated by the encroach-
ment of an existing building upon the Town's right-of-way.
It is my understanding that by letter of March 2, 1981,
Mrs. McDonnell has submitted a request for an exemption directly to
the Works Department for their consideration. This matter, therefore ,
will, no doubt, be reported on by the Works Department and an appropriate
recommendation made to Council, through the Public Works Committee. Such
a recommendation; however, should clearly request Council to direct this
Department to prepare the necessary by-law amendment, provided, of course,
that the Works Department is willing to support the requested exemption.
In addition, and quite separate from the rezoning, is the fact that an
entrance per-mit would also be required prior- to the issuance of any
building permits . Presumably this could be dealt with at the same
time as the rezoning, however, it is a matter within the Works Department 's
jurisdiction and Mr. Dunham can best advise you of the procedures involved.

Further to our telephone conversation today, I am enclosing here
a sketch showing part of Lot L and Part of Lot K in the Village of
Burketon. This is outlined in red and is on the market with an
offer to purchase having been accepted by the Vendor conditional
upon the issuing of a building permit.
Our agent, Kellie McDonell, has- done her best to cover the necessary
ground, and I am enclosing here a copy of Mr_ Jack Dunhams letter of
February 23, outlining the fact that he is knowledgeable about the
property and about her needs. -
We certainly would appreciate some guidance to help direct us through
the awesome number of steps one must take in order to sell a piece of
property that is truly suited for residential purposes: In addition
we have a willing buyer and a willing seller and we would like to be
able to go through the proper procedures as quickly as possible. I
would certainly appreciate you giving this some of your time and

Further to your letter attached regarding Block C & Block K,
Part Lot 20, Concession 10, Darlington Township, in the Village of
Burketon.
I have been advised by Terry Edwards that according to 4 (F) of
2111 a minimum of 66 ft. road allowance is required.
I hereby request on behalf of Mr. William Virtue and Mr. & Mrs.
Harry Kokke that this portion of the road be redesignated or exempted
from this restriction, to allow an entrance permit to be issued to
the Kokkes to enable them to build a home on the five acres outlined,
designated Infill and Zoned R3 on the official plan of Burketon.

Regarding the enclosed sketch prepared by
Merrill D . Brown , regarding part lot "K" on Mary Street ,
Burketon , I have the property for sale and have people
who wish to buy it to build a home .
I have been advised that a building permit
would be available if an entrance permit could be obtained .
I have been advised that an entrance permit could be
obtained if it ' s on an open road . I have been advised
that if the road is Ploughed and sanded , it ' s an open
road; however , if you drive up and view the area , everything
checks out ; the Plough and sander even turn around on the
lot in question , but there appears to be a house built on
the road allowance from there (see sketch. )44z4-,'.
If the road needs improving to where they would
Put their driveway , what would the cost be to improve it ,
give or take a few hundred dollars?
